Reflections of 9/11 in 2014

Today Americans will be reflecting of the nightmare that occurred on 9/11 in 2009 when 3,000 people lost their lives in the attacks on on the Twin Towers and also in 2012 when Chris Stevens and 3 others lost their lives in Benghazi.

We reflect not only on the lives that were lost but the circumstances surrounding those tragedies in our history that are all to often forgotten. The latter portion of this video is indeed a tribute to the lives that were lost, but the beginning of this you tube video reflects on the jokes Obama made at the correspondence dinner about his identity poking fun of the stand for the Constitution so many of us have stood up for in the qualifications for the Office of the President he fails, also a recognition of the circumstances around Bid Laden's death said to perpetrate and mastermind the 9/11 attacks that must be recalled and the 'honorable' burial at sea Obama was said to give Osama as a respect for Muslims when no muslim state would take his body, rather than bring Bin' Ladens' body back to the U.S.

If the very essence of stopping world war is to criminalize the actions of a few, rather than allow the actions of a few to be blanketed upon whole populations, criminal investigations can save us from global catastrophe and are very important.

Our hearts can not help but grieve for our losses. The troubled waters of our peace cannot forget watching all the buildings fall at different times and under different circumstances as we watched suicide planes crash into a couple of them, and we must recall the 'video tape' that was blamed on Benghazi by Obama and his Administration just a month before the 2012 elections generating the sparks of unrest and infuriating muslims all over the world after September 11th, 2012 in the arab springs saga.

Sometimes it is difficult to understand the differences of why Obama chooses to honor Muslims in a burial of Osama bin Laden, yet infuriate a blind rage within their radical elements against America blaming Benghazi on a videotape. Why the White House and our Government strongly objects to pictures and analysis of a shot dead Bin Laden for a forensics and a criminal investigation, but request removal of multiple video's showing beheadings of american journalist only after they have gone viral, like the video tape they attributed to Benghazi's circumstances.

May God Bless America for the truth and help us with our troubled waters. May we as Americans continue to understand as the example that our Constitution defends all religions and the freedom established here. May we as Americans continue to understand all religions also are afflicted with the challenges for good and bad that people in their individual capacities are trying to overcome as weaknesses and that we in defending our own personal religion must fight to defend that which we may not entirely agree with, that in this resolve peace can be found and a harmony of spirit championed we distinctly call American.

That religions of all types in their essence have a purpose to make good people even better, wishing to worship God according to the dictates of their conscience, allowing all men to do the same and that to be just we must act justly realizing in our Constitution the qualifications for the Office of the President, when corrupted, can quite easily lead to the corruption of our religious peace dividing us in a disrespect and discord.

My prayer for the United States of America is to preserve our Union and to this end I have dedicated much of my time,my passion, and my life in the understanding of how very important our United States Constitution is as the Supreme Law of this Land upon a happy people.

It’s raining right now, a little thunder rolling around with the lighting so high in the cloudy sky you can’t see it. We know lighting always occurs when there is thunder. That piercing burst of electrical charge we call lighting is what causes the sound. You may not hear the thunder for quite some time after you see the lighting. In fact we used to count after seeing the lighting, one-thousand-one, one-thousand-two, one thousand-three understanding that sound was traveling slower than the light that had reached our eye and represented the sound traveling a mile upon ever count.

When I think about Obama’s ineligibility in the Office of the White House, I think of all the voters, both Republican and Democrat who were deceived about Obama being a ‘natural born Citizen’ qualified under the increased criteria of all three categories ‘natural born citizenship (Born in the U.S. to Citizen Parents), age-35, and time in the U.S. 14 years, as compared to those qualifications tiered down from the offices of a Representative, or Senator.

It seems no one disagrees that you have to be at least twenty-five (25) years old to be a U.S. Representative, and thirty (30) years of age to be a U.S. Senator, and thirty-five (35) years of age to be President as an increasing criteria of qualification. No one disagrees with the United States Constitution that separates with another increasing demand upon the qualifications of the offices when it comes to ‘time’ of being a ‘Citizen’ for a U.S. Representative its seven (7) years, for a U.S. Senator nine (9) years, and finally to be President you must have been a resident fourteen (14) years.

Quite clearly a distinction happens upon the Office of the President in comparison to the Offices of a Representative in more three ways.

1) You have to be thirty-five (35) years of age.
2) You have to have been a residence in the United States fourteen (14) years.
3) You have to be a ‘natural born Citizen’

Many people look at the time for a U.S. Representative to be a “Citizen” of the United States seven (7) years, and the time of a U.S. Representative to be a “Citizen” nine (9) years as the same qualification as the President’s qualification to be a “Resident” fourteen (14) years.

If it was the same type of Citizenship requirement we would see it read “the President must be a “Citizens” fourteen (14) years. However, the word difference in that requirement is as different as night is from day. Clearly, Representatives and Senators are held to be “Citizens” seven (7) and nine (9) years respectively, and the President a “resident” fourteen (14) years.

Now is that because we don’t expect our President to be a Citizen? Not at all, in fact we expect that the President actually be a ‘natural born Citizen’ which meant he/she be “born in the U.S. to Citizen Parents”, which is not required in the term “Citizen”. We know aliens can apply for U.S. Citizenship through a process called ‘naturalization’. These citizens can go on to be Representatives after 7 years and U.S. Senators after 9 years, but they can never be President, but if married to a U.S. Citizen and afterwards having children, these children could be President some day.

This language difference between ‘citizen’ and ‘residence’ is one of two testaments that exist which plainly declare a ‘natural born Citizen’ be something that a ‘citizen’ is not. The other is of course what we refer to as the ‘grandfather’ clause in the Office of the President’s qualification.

This is where we do see the word “Citizen” used as a qualification for the Office of the President instead of ‘natural born Citizen’. In that clause we see the President must be “a ‘natural born Citizen’, or a ‘Citizen’ of the United States, at the time of the Adoption of this Constitution”.

Other unique distinctions exist between the Office of Representatives and Senators also from the President in that they must be an ‘inhabitant’ of the particular State in which they seek office.

Of course many of our first presidents did not have parents, who were citizens of the United States, and some had not been born here, however, George Washington was born in Westmoreland County, VA., under British Rule. George Washington’s father was Augustine Washington also born in VA in 1694. His mother Mary Ball Washington was born in Lively, VA in 1708 under British rule: So none of them were born in the United States and neither was Sen. John McCain, but he didn’t qualify as living at the time of the adoption of the Constitution and was ‘naturalized’ by an Act of Congress specifically for the Panama Canal Zone.

Should Sen. McCain be exempted from the qualification demands when the people being naturalized yesterday are not? Further proof exist that Sen. McCain knew he was not a ‘natural born Citizen’ because he rounded up his friends in the Senate and they all made up non-binding U.S. Senate Resolution 511, which declared him a ‘natural born Citizen’. Why would someone ‘need’ something like that? I’m a ‘natural born Citizen’, Born in Idaho Falls, Idaho, and both my parents qualified as Citizens. I didn’t need an act of Congress, but Sen. John McCain has had two acts of Congress acting as a buffer of naturalization for him.

U.S. Senate Resolution 511 failed to pass in the U.S. House of Representatives and was not signed into law by a legal President so in no way, shape, or form did it change the qualifications for the Office of the President. Then Sen. Hillary Clinton and Sen. Barack Obama were co-sponsors of the non-binding senate resolution for Sen. John McCain and every Republican U.S. Senator except Sen. McCain voted for it in a Democratic Party controlled U.S. Senate.

What an honor for Sen. McCain to have Democrat Claire McCaskill also sponsor the bill and have every Republican U.S. Senator in the minority vote for it. Do you think every ‘naturalized’ immigrant ought to have the same preferential and elite privilege? If anything this serves as an example of a form of discrimination towards the rest of us that current elitism can be demonstrated by Congress in the form as grievous as receiving ‘titles of nobility’ that are stated shall not be granted by the United States.

‘Titles of Nobility’ frowned upon as a shadow of tyranny shall not be granted by the United States is our law, and isn’t the idea surrounding ‘Titles of Nobility’ really at the root of making most people servant to the law, and making a few ,or even one, exempt from it?

As a Candidate for President in 2008 I sued Sen. McCain for dishonoring the Constitution’s qualification demands for the Office of the President as he was a violation of the law in that Office. The District Court Judge waited until after the election to make his final ruling ignoring my protest of such because so much money was being wasted on an unqualified candidate. Indeed, he ruled it was ‘moot’ only because Obama had won, thus Sen. John McCain was not actually in the Office of the President in order of a violation.

Does that make Republicans happy about all their campaign dollars in 2008 going full throttle for a walking talking violation of the Office of the President as a ‘nominee’? I don’t think it would, but hell has no fury like the Republicans when their ‘man’ has a problem with qualifying for the Office of the President.
Indeed it seems the Republican Prayer to God goes something like, “God grant the hell on earth released upon Obama in his ineligibility, but grant thy heavenly mercy upon a Republican Nominee oh Lord”. Why can’t Republicans see their own hypocrisy?

Indeed every day I wonder who I’m fighting more of and more for Republicans or Democrats? I’m fighting Republicans on the issue of whether Sen. McCain based on military service that so many other naturalized citizens also have but do not qualify, as well as unqualified yet potentially considered by Republicans to be front running undeclared candidates for 2016 like Sen. Ted Cruz, Sen. Marco Rubio, Gov. Bobby Jindal, and Sen. Rick Santorum who I know went through 11 million dollars of campaign contribution holding a Canadian citizenship in his 2012 run.

How is this legal or even ethical moral high ground for any of those unqualified candidates? When you exempt yourself from the laws demanding a ‘natural born Citizen’ in the Office of the President, not only do you slide into a miserable abyss for yourself, but you become a cheering partner for the other party’s unqualified candidate in Obama who now is in the Office of the President as an unqualified person and you become a party to the problem and present yourself as a domestic enemy of the United States Constitution supporting those destructive forces of our sovereignty and in short the greatest national security breach in the United States history!

In such a position I question what ground you stand on with our Creator. I imagine every hard earned campaign dollar given to you by an unsuspecting grandmother or grandfather in their desire and prayers that our United States Constitution be upheld in these perilous times and I get sick to my stomach in the thought of defending you in front of God as a leader. If I can’t defend you in front of God as a leader and maintain the moral high ground in my conscience something is wrong.

I can’t even comprehend your defense and affidavit to God about every campaign dollar you stole when you were not qualified for the office that you sought should you be elected, as you recited in your candidate’s oath of office.

As I worked on and released a new commercial for my book, “Taking A Stand the conservative independent voice”, I reflected on the powerful message that my witness holds in the pages that is even more poignant now in 2014 than it was in 2008 when I was running and in the absolute battle against McCain and the Republican Establishment in the Republican National Committee who received the law suit three (3) days before McCain was made the Republican nominee in 2008.

Now when you look back on this you absolutely have a witness that there was a Presidential Candidate who was challenging McCain before Obama on the ‘natural born Citizen’ qualification clause of the Constitution and what does that do to all the ‘racist’ and ‘discrimination’ charges asserted by the Media for those challenging Obama? It neutralizes them and when you pull the race card away from Obama and make it all about being American that is BIG, because he is thriving on the opposite, but he’s doing so with Republican consent!

When you put that into context with 10 Trillion Dollars stacked on our national debt, over 25 scandals that have erupted in 2014, that may not have erupted if Obama was not in the Office of the President, including Benghazi, Fast & Furious, all the spying and manipulation scandal of and on the Media and the American Public, you begin to understand the implications and the historical importance of this book’s witness.

If every American had read “Taking A Stand” in 2008 and it had been heralded on the New York Times Best Sellers list, guess what? Obama would not even exist. If Obama didn’t exist what else would be missing? How important is a witness that we respect as being filed in a Court of Law by a Presidential Candidate with standing for the “natural born Citizen” clause in race relations?

I am the only Presidential Candidate in America whose witness came against McCain and Obama in Court that the Media could take to the bank. I declare this as a peace between all races in America. The honor was mine to defend the Constitution and with my actions I have done everything I could think of to celebrate our Constitution as a law above every American’s head, not just most of us.

This is why I believe you should buy this book and spread it to your neighbors and declare it as truth in your social networks. The power of it is remarkable in bringing us together under the Supreme Law of the Land, rather than dividing with the tacit embers of racial discrimination.

Back to School & Congress Back in Session - No, We Didn't All Screw That Up

No, we didn’t all ‘screw that one up’. We didn’t all hop on the bandwagon of Obama being eligible for the Office of the President and we didn’t all decide that the Constitution’s qualification for the Office of the President all of a sudden had been regulated to be any person who was a Citizen. That didn’t happen.

What happened was a few people decided they could ‘trap’ a whole bunch of other people in a conceived ‘racial trap’ if by giving Sen. John McCain a pass on his natural born citizen test and his being born in Panama in the Panama hospital, not a U.S. military hospital, and conceding McCain’s native born citizenship to the foreign nation of Panama excused as a foreign citizenship, and complacent with allowing dual citizenship in the Office of the President, that there would be no political opposition to Obama’s foreign citizenship also being allowed in the Office of the President. That’s what happened.

Whose white-picket-fence-leave-it-to-beaver front yard fell into a collapsing septic tank buried 10 feet down? Who didn’t see that one coming? Well, pretty much every Republican Candidate for President or Vice President over the last two presidential election cycles.

Yes, they are all standing in the septic tank now, and the only way out is to laugh it off and say, “Well, we all screwed that one up didn’t we?” That pretty much levels the playing field doesn’t it? There’s only one problem with the statement. We didn’t “all” screw that one up. Some of us didn’t screw it up at all and some of us didn’t screw it up just once but actually did it twice as in Mitt Romney not seeing it with McCain in the 2008 Republican Nomination in 2008, and after he won the Republican Nomination in 2012 not seeing it with Obama.

Not to be outdone in screwing it up, let’s not forget Hillary Clinton screwed it up twice also. Once with John McCain and once with Barack Obama, both in 2008, had she stood up and fought it out with McCain, Obama wouldn’t have had a chance. I’m sure there is a missing book to be written about this; the hope’s, reason’s , why’s, and the political strategy she chose that didn’t pan out like a missed window of opportunity closing on an athlete’s aspirations because of an injury. It just happens and there isn’t a lot you can do after the fact except down play it, dismiss it, or just simply to declare everyone is standing in the same septic tank.

I think the most important questions of our day politically speaking are, “Which was it, not seeing McCain’s or Obama’s ineligibility, or was it just a blatant disregard for the Constitution’s Qualification Demands for the Office of the President? And, “What are the ramifications of not seeing it, or dismissing it as a standard of principle or morality in the context of our national security and the job or duties of the President?” Context of our national security really entails maybe estimating how big it is on the, oh let’s say the ‘Richter scale’ like comparing it to an earthquake. What are/were the ramifications? How many people did it affect? What were the damages?

These are all legitimate and reasonable concerns. Politically speaking, “How big of a screw up was it in total?”; Did it have the negative impact on a relative small portion of the population, say like a non-binding senate resolution effecting the girl scouts of America, or did it sack the whole United States of America with 10 trillion, promulgate ISIS/ISIL and lead to the total breakdown of safety in America and the error apparent strategy of beheading mainstream media broadcasters as a political tool to incite the United States into a third world war?

Don’t you just love moral crusades without any morality involved? They are easy campaigns aren’t they? Being easy is right next to being slutty, and boom you are right back into being in the septic tank covered in smelly waste.
Okay, let’s count the number of politicians who saw this coming and stood up against McCain and Obama in 2008 and 2012 as a Presidential Candidate. That should make things a little easier shouldn’t it? Ok.. one- Cody Robert Judy, that’s me, ummm, two… ? Hummmm? Can you please help me with two? Come on, it can’t be that hard. Who has a Court record against McCain and Obama in 2008 and 2012?

There has to be some passion out there for the United States Constitution and the safety of every man women and child in America, not to mention the enslavement of 8 Trillion Dollars? No?

Ok, let’s go about this a little different way; maybe saddle Cody Robert Judy with some more weight because he’s just too far out there in front of the pack to even make the competition have a chance. Let’s just open the presidential field to potential candidates with a good moral compass. Let’s take all people who have a national microphone to the test and list how many of them used that microphone as a defense for America over the last 7 years on Obama’s ineligibility?

Dr. Ben Carson, let me ask you where were you? Where have you been on this issue? Mr. Allan West, let me ask you, where were you? Where have you been on this issue? I do know where Dr. Pastor James David Manning has been, especially after speaking to him in his office and handing him the U.S. District Court case of mine entitled Judy v. McCain. That wasn’t racist that was American! We hold ourselves accountable to the law in a Constitutional Republic.

Now do we forgive people here in America? Of course we do., but the prerequisite for forgiveness is at the very least an admission and a change of direction. How can you forgive if people say ‘we have not offended?’ That’s what we are seeing with politicians across America and I have to say it’s pathetically weak. You want someone strong, look to find someone who is willing to take responsibility.. right? Isn’t that what most of the teachers across the United States are recommending to our children right now in the first week of school? Who in Washington DC wants to take responsibility for the U.S. Constitution’s demand for a natural born citizen in the office of the President?

It’s the most referred position in the U.S. Constitution thirteen pages in the pamphlet. Its’ not a light or transient reference like oh, let’s say the whole Navy mentioned twice. I have to ask people what exactly they consider important when it comes to leadership because I see a lot of people mobilizing behind the formulation of national campaigns that might be blown away by the huff and puff of the big bad wolf because their houses are built on straw or sticks.

This is not a self aggrandizement in the least and if you’re seeing this that way I think you need to consider the ramifications of what’s happening, and what has happened with more than 25 scandals that didn’t necessarily have to happen if Obama wasn’t in the Office of the President as an unqualified individual. If you start taking that a little more seriously I think you would see my interest as a plea for others to ‘repent’. If you have lost the understanding of the power of repentance, you have lost the understanding of love.

If you know longer want to hear your children say when they have done something wrong, “I’m sorry”, simple little words that invoke mercy and compassion to the threshold, by all means stay on course. But if you do understand the great love, mercy ,and compassion ignited in the hearts of just people, at the words “I’m sorry”, you will understand repentance is ‘empowering’, not disabling’.

Do I think the American People have the power to elect politicians who at the very least would say, “We are sorry, we didn’t take a stand against Obama’s ineligibility, but we are doing so now. Please forgive us.”? Why, yes, yes, yes, I do.

I am praying for you every day and I need your prayers to. I have every capacity in my being that is willing and ready to support those who will do this regardless of political party. America the beautiful is an America that turns to God for answers; not necessarily out in the streets or in a church in front of a bunch of people as much as in your homes and in your secret places and most importantly in your heart.

An actual prayer in your heart is of great value in the heavens and does not fall on deaf ears, but is heard and attended to by angels and felt by God who is also moved with compassion and is not screaming repentance to disable you, but is whispering repentance as a hope and encouragement so you can recognize an empowerment in yourself. What a wonderful hope we have for our children to fly on eagles wings. How is it you don’t understand your Father-In-Heaven wouldn’t also want you to fly?

As you understand your own ‘hopes’ and ‘dreams’ for your children, you also understand God’s for you. Do you not wish the best for your children? I know you do. So I also understand that you do not want them to go in and rob other people of what is not theirs. That basic morality is traced right back to the Office of the President and in keeping with the hopes of your own children’s ability to fly, each principle kept has a reward of strength and encouragement, and those unkept are disastrous mines that hold us back and impede our journey.

Our children are going back to school, and Congress is coming back in session, let’s hope we can hurdle and learn a few things that were holding us back this new school year.

Who says being clerk is a lowly job of no particular importance? That is certainly not the case in the U.S. District Court in the State of Utah where the Chief Justice and Presiding Judge Honorable Ted Stewart just handed the Clerk of the Court the responsibility wherein the fate of the whole United States of America and $141 Million Dollars waits with anticipation on the clerks ruling on a "Default Certificate".

Before submitting the Motion for Default and the Proposed Order I called the Clerk stating a Certificate of Default was necessary to which I was told by the Clerk that it was up to the Judge so I made a Motion for Default and an Order up and sent them in. Now I have an Order from the Judge saying that its up to the Clerk.

Its odd working in the same building with multiple Clerks working tirelessly from 8AM to 4PM Monday through Friday for the Judge himself, and other Clerks working in the receiving room that someone didn't mention something at lunch like "oh yea, did you get the Judy v. Obama Certificate of Default up to Chief Judge Ted Stewart? You know the Defendants were served and didn't respond to the Courts Stamped Summons, and its long past the 20 Days that the Court requested an answer or Default by Judgement would be taken against them."

Well its probably because of the work load! I mean who can keep track of these things, thousands or at least hundreds of cases being filed right? What? What was that, this case is number 93? You mean its September and they haven't had 100 cases filed this year yet? Let's see here, between 14 Judges that's 6.6 lets round that up and say 7 cases per Judge and its the end of the 8th month so, a little less than 1 case per month per Judge.

That is understandably a mystery. I'm sorry, perhaps I am being a tiny bit facetious, but that's how I felt when I read that the Chief Justice was going to "leave the determination to the Clerk of the Court in the first instance.", when he could have made a phone call and got the report from the clerk in 5 minutes.

I actually don't believe the Judge didn't make that phone call, or that his personal Clerk didn't say Hi to the Clerks down stairs or some how didn't talk about it at lunch, on their break, or in passing each other in the halls. That just seems like an impossibility to me especially with those kind of names on the case.


So anyway, today I received from the Presiding Judge Ted Stewart of the United States District Court ((Utah Division)) a August 26th signed MEMORANDUM DECISION AND ORDER OF JUDGEMENT on the Motion For Default and Proposed Order that I submitted to him. If you haven't read the Motion for Default or the Order you can do that here and I'd recommend that you do and after we can discuss a little bit of what we can determine based on what we have so far. That's the really fun part of all of this you political and legal crack junkies you. (smile) Hey if you can't have any fun with this or maintain a sense of humor, you really are in danger of losing it all. We can talk some serious things, and we can laugh and crack a joke or two at the same time.

Now that you've read it thoroughly and have some idea of what we are talking about, especially the MOTION FOR DEFAULT, you can understand Judge Ted Stewarts first paragraph in the Memorandum Decision.

"This matter is before the Court on Plaintiff's Motion for Default Order of Judgement.(reference No. 6 docket) In his Motion, Plaintiff asserts that Defendants have been properly served and have failed to appear or otherwise defend within the time allotted by the Federal Rules of Civil Procedure. On this basis, Plaintiff seeks a default judgement that includes an award of $141 million in damages."

Can't you just see the Judge looking at his Clerk and very slowly saying, "one hundred forty one million dollars- That's a lot of cash to dismiss in an Motion to Dismiss Default Judgement if it was granted. Whew!"

Before I get to far in to this report, let me just clarify a few basics just in case a few of you decided you didn't want to read the Complaint, the Motion For Default and the Proposed Order. This case actually does something unprecedented in political history! You have probably never thought that a political contribution was an investment that could actually increase in your whole life.

Can't you just see all the contributors of former Gov. Mitt Romney, Sen. John McCain,Sen. Hillary Clinton's and former Senator Barack Obama's 2012 presidential campaign scratching their heads right now trying to even comprehend how a political contribution could increase let say a hundred fold. That's where a $25 dollar contribution is refunded as $2500 because the contribution was given with a certain expectation of the 'rules of the race' and having the rules changed and not being notified of the change before the race started actually caused an inconvenience that needed to be reimbursed because of basically fraudulent circumstances?

Well, that's what I've actually proposed in this law suit that I would do to with every person that actually contributed to my campaign because we didn't know the the "natural born Citizen" qualification had been canceled in the U.S. Constitution by Republicans and Democrats presidential candidates in U.S. Senate Res. 511 where Sen. Hillary Clinton, Sen. Barack Obama and Sen. John McCain all made a deal that it would be changed and every U.S. Senator not apart of that voted for it.

Of course I wasn't there and neither was America or the 300 million Citizens of the U.S. to see the change that a non-binding U.S. Senate resolution had on an Article II of the Constitution that defines the rules and qualifications of the race for President so we just need to get our money back and some damages for not informing us that the U.S. Constitution had been changed, because if we had known it was changed we certainly wouldn't have run the races or contributed our hard earned money.

Can you imagine Mitt Romney doing that? Telling all of his contributors, "Hey you guys deserve a refund and some damages because the rules got changed and I wasn't in on it"? Well, that's kind of what I've said and I think its fair especially when we have a standard and there are rules. So we basically, just get a refund and Obama stays in the Office of the President. Of course that is unless Congress catches wind that a refund has been given to all the contributors based on a breach of the Constitution. Then of course, Congress is free to act as they will given the circumstances.

Those contributing to my campaign I'm sure will be very happy about their refund coming, while there probably will be a few people who contributed to rich Mitt Romney who are still less then satisfied. Oh, so it goes. I mean you certainly get a choice at who your going to support. Can you imagine the disappointment of those who gave to all four McCain, Romney twice, Hillary Clinton, and Obama? They will probably be really disappointed. That's like betting on every horse on the race except the one that won or did some good for you! (hahaha)Who says you have to win the race in order to win on principle? Who says 'principle doesn't pay off?'

Okay, back to the Judge's second paragraph-
"Federal Rule of Civil Procedure 55(a) provides that "[w]hen a party against whom a judgement for affirmative relief is sought has failed to plead or otherwise defend, and that failure is shown by affidavit or otherwise, the clerk must enter the party's default." Then, "[i]f the plaintiff's claim is for a sum certain... the clerk- on Plaintiff's request, with an affidavit showing the amount due-must enter judgement for that amount and cost against a defendant who has been defaulted." (reference Fed R. Civ.P 55 (b)(1). However, where, as here, the judgement sought is not for a sum certain, or for a sum that can be made certain, "the party must apply to the court for a default judgement." (reference 3 Id. 55(b)(2)."

That's kind of a mouthful, but I guess what it means is I need to submit an Affidavit to the Clerk, even though a signed Motion and an Order in my mind is kind of the same thing- an affidavit is sworn to and has a specific amount.

Third Paragraph-
"Plaintiff has applied to the Court for a default judgement. However, Plaintiff has not yet received a default certificate as required by Rule 55 (a). Until Plaintiff receives a default certificate from the Clerk of Court, the Court cannot reach the merits of Plaintiff's Motion for Default Order of Judgement. For this reason, the Court will deny Plaintiff's Motion without prejudice. In so doing, the Court does not reach the merits of Plaintiff's claim of proper service or entitlement to a default certificate. Rather, it will leave that determination to the Clerk of Court in the first instance."
Fourth Paragraph-
"Based on the foregoing, it is hereby ORDERED that Plaintiff's Motion for Default Order of Judgement (Docket No.6) is DENIED WITHOUT PREJUDICE. DATED this 26th day of August, 2014. (Signed by) U.S. District Judge Ted Stewart"

You know I have to say I think that was very nice of Judge Ted Stewart, I really do. You know when I opened the envelope up I thought here we go, another "DISMISSAL in your face you don't know what the word frivolous means do you? YOU MUST BE STUPID STUPID STUPID", type of an ORDER. I don't feel that way at all with this Order. I think it was very concise and I didn't feel STUPID STUPID STUPID, even though and I'm sure he knows, I could easily qualify for that kind of insult legally speaking with years of inexperience rather then the years of experience he has.

You know I'm never offended with intelligence and quality and I've got a pretty good eye at recognizing quality. Yes, even in my ex-wifes. I sure didn't marry them because they weren't quality women. I never thought to myself, " I wonder why I married her?". I knew why I did, and never regretted it with all three.

So now let's briefly discuss what Judge Stewart didn't do, that he actually could have. If for instance he had DISMISSED the Motion with PREJUDICE or DISMISSED THE COMPLAINT as frivolous that would be the end..good night..turn off the lights. You don't bother the Courts again with this. That's it. He did'nt do that and I love him because he didn't do that and he could have.

There is nothing that means more to my heart then 'good judgement'. Its for me like admiring a supreme performance by a reining horse that spins like a top and slides 60 feet on a lose reign with just a few cues from the rider. That to someone else might be like admiring a really rare piece of art and understanding the artist, the history, and value of a favorite collection, or how about a mother who tries to explain the beauty of her sleeping child as her heart swells with joy this child brings her?

I know it sounds strange, but losing a race the best that you can is every bit as important as winning with your best effort. If you give it all you got and lose, its okay to walk away. When I think about all the "likes" I've got on facebook from the general public people who don't even know me, and their sharing what I've written I am so humbled and filled with gratitude. Its just amazing. When ever I've received a contribution in the mail or on line from my web site I've remembered to thank God for that and treated it just as honorably as the widow's mite Jesus pointed out was so valuable.

Is Mitt a Hit or a Misfit?

Is Mitt a Hit or a Misfit for the Office of the President?

The speculation that Mitt Romney may or may not 'run' for President is once again blasting ears of the American Public like a reverb button that has been turned up high and continues to echo in your head. On the Democratic Party side we are blasted in the news with Sen. Hillary Clinton's mojo, as if her giving up against Obama in the Democratic Party nomination was a reward for receiving the nomination in 2016.

Is there a hit in Mitt and Hillary yet or do we have old school songs that have been remixed one to many times already? Don't get me wrong, I love Tanya Tucker singing Delta Dawn, but I keep wondering if America still hasn't heard the notes that were not quite in tune when it comes to the actual job requirement of the President in defending, protecting, and preserving the United States Constitution?

If you recall Mitt Romney ran for President in 2008 losing the Republican nomination to Sen. John McCain. He re-rallied the forces for another ride in 2012 this time hurdling the Republican Nomination he'd tripped over in 2008 only to experience a melt down with Barack Obama in the 2012 showdown general election.

What Mitt failed to do in his campaigns of 2008 and 2012 was actually defend the United States Constitution from an unqualified candidate. Both McCain and Obama were not 'Born in the U.S. to Citizen Parents' as is defined in the term 'natural born Citizen', the requirement for the Office of the President in the United States Constitution. Excluding foreign influence in both nature and nurture the Office of the President is unique in its requirement from U.S. Representatives and U.S. Senators and a foreign influence can permeate that office either by a foreign birth or a foreign or alien parent.

While being born outside the United States or being born to an alien parent does not make your skin blue, it does create a certain allegiance that persons "born in the U.S. to Citizen Parents" are not subjects to in a legal arena as far as being granted a foreign citizenship that might create a dual citizenship prohibited in the Office of the President. The question is not is the alien citizenship employed, but rather does the alien citizenship exist? If it does, that is prohibited from the Office of the President in the United States of America.

Its not a matter of 'discrimination' its a matter of 'qualification', much the same as the age restrictions also noted are different from U.S. Reps, U.S. Sen., and U.S. Presidents, or for that matter the age restrictions on driving a car, or buying alcohol exist. Allowing infants to drive your car, or juveniles to buy your alcohol is illegal and is not lawful, yet the voting public has over the last two presidential cycles not had any candidates in the major parties that have agreed with the law.

If you like the idea of 'infants on thrones' you need to understand there is a difference between someone who is of wise judgement and that being seen as good or innocent like an infant, and the negative contraction of the idea existing stating, those who are not qualified or fail to qualify should not be allowed in the Office for good reasons much the same as we don't allow people who are 7 to drive or those who are 14 to buy alcohol because your just asking for an accident to happen.

Like former Gov. Mitt Romney failed to challenge Sen. John McCain in his 'qualification failure for not being born in the U.S. but receiving his native born citizenship from Panama and generally populating the idea that McCain had not one but two Congressional Acts on his Citizenship generally formed under the 14th Amendment or non-binding U.S. Senate Resolution 511, Hillary Clinton failed to do the same thing on Barack Obama. In her democratic party campaign she failed a most basic objection to his candidacy for the nomination in 2012 which ultimately could have prohibited any further crisis and given her the nomination. This is why I say she 'gave up' against Barack Obama in her campaign and failed to do the most basic duty of a President in objecting to an unqualified candidate in the race.

Mitt Romney went on to repeat Hillary Clinton's failure, and thus suffered the same defeat.

The premise is very basic but reveals or uncovers quite a bit,If you can't at the very least stand up and defend, preserve, and protect the U.S. Constitution while your in the race for President by objecting to unqualified candidates in affect threatening the office of the President unlawfully, how are you going to do it if you were elected? Why should someone be rewarded with the Office of the President who neglects the most basic task from the very beginning?

Now through out this stage of experimentation with our Republic, that's the Republic for which we stand, for those who have forgotten the Pledge of Allegiance, neither Mitt Romney or Hillary Clinton have changed their tune about Barack Obama who is not a qualified individual in the Office of the President. One of the very basic tenants of a Republic is that elections don't over-ride the Constitution but are suppose to co-inside with the Constitution.

What that means is that it does not matter how many people voted for Barack Obama without being educated that he was not a natural born Citizen, what matters is the Constitution and one person standing up and saying so. One person can stand against every one that voted for Barack Obama. In a Constitution Republic, if that one person is right by the Constitution, all those votes really do not count because they were cast under a veil of fraud, deceit, and cover-up of an identity.

The way I see it as the only U.S. Presidential Candidate who actually as a matter of record in Court objected to both McCain and Obama's qualification for the Office of the President all the way through the election cycles of 2008 and 2012, is if the tune hasn't changed, its probably the same old song. I've been waiting for an objection cast from the lips of both Mitt Romney and Hillary Clinton, but so far all I hear is silence. There is no music being played that would turn me on. In fact I actually see a confirmation that indeed their tune hasn't changed.


Recently Mitt Romney said, "I mean, you hope you learn from your mistakes," he said, "but at the same time, there are people who are not yet known by the American public who have extraordinary records, great capability, Paul Ryan being one of them, Scott Walker, Bobby Jindal, Marco Rubio. Of course, people are getting to know Chris Christie. Jeb Bush, they don’t know Jeb Bush as the governor of Florida, and the kind of record he has and had there. These are people who I think have the potential to really ignite interest in our party and potentially win the general."

No offense Mitt, but even some of your recommendations as far as 'good people' for the Office of the President would be walking talking violations of the U.S. Constitution if they were to win the Office of the President. I can not recommend 16 year olds buying alcohol and say that it is good. It has nothing to do with Marco Rubio or Bobby Jindal not being good fathers or parents or a good U.S. Senator or Governor it has to do with the qualifications the American People have set up for the Office of the President that both Marco Rubio and Bobby Jindal fail.

Now I don't think Mitt Romney is a bad guy or Hillary Clinton is a bad gal nor do I think Barack Obama is a bad guy. There are many good qualities about Romney, Clinton, and Obama as well as McCain, Rubio, Jindal, Cruz,as well as Santorum all of whom I even recently challenged in the ALS Ice bucket challenge, only because I knew Mitt had already done it and challenged his wife also, but we have to start facing facts.

If all of these people recommend that 16 year olds can buy alcohol and 7 year olds can drive, maybe their advice is somewhat of a misfit and not something we want in the Office of the President? They are all free every day to accept a challenge and begin fresh and I for one sincerely hope they do, because nothing would be better to me than if I could have someone to vote for who was legal besides myself.

Will Mitt Romney take another run who knows? What I do know is that the tune hasn't changed. I've written some 60+ songs and many of them I actually dreamed about. You can imagine my surprise when I leaped out of bed with this tune being chanted in my head during my sleep by not just me but many many people. It sounded pretty good as a chorus of many people, not as good with just me, but look at the date on this thing and then ask yourself is Mitt Romney running again as a hit or a misfit?

I just checked this link and its only been seen 11 times! You know how hard that is to do with a video published June 20th,2013, over a year ago? ( smile ) Maybe the 'reverbs' a little to high? Let's hope they all change their tune!

MY MUSIC MY HEART


If every single person had to write a song that reflected their personal life, what would that song be and what would it sound like? Would it be a "Happy-Go-Lucky" song, would it be a "Love or Romance Ballad", would it be a "Tragic Melancholy", would it be a Violent, Angry, or Frustrated Headbanger? Truth is, everyone of us has a few songs on each subject we could write.

Maybe you are not putting 'notes' and 'rest' and 'rhythm's' to your song because you don't know the first thing about writing music and only know how to listen to it. That's great, but you are still writing a song about your life. We all are. Maybe it doesn't come through to your ears, maybe you are a painter or an artist of a different understanding; words,stories, experiences all become a part of your song, but make no mistake about it, you are an artist.

The words in a document like the United States Constitution are a song, as are the fittings of a plumber, the casing of a carpenter, or the engine of a car all contributing to our collective song. Mine is unique as is yours, we are not the same people. We are individuals.

Do you remember the movie "WALK THE LINE" starring Joaquin Phoenix, Reese Witherspoon, Ginnifer Goodwin, and Robert Patrick? I always remember in that movie when Johnny Cash played by Joaquin got his first try out. He and his band went and played an old gospel song. The Studio Producer said and I'm paraphrasing here, 'Well, I've heard enough you guys got anything better than that? We've all heard that song played that way a hundred times. If you were about to die, is that the song you would choose to play, or would you play something different?" You can see a little reminder of that scene here at about 29 seconds. Of course in the movie Johnny Cash plays a song he had written while in the army "Folsom Prison Blues".

The point here as I reflect is we all are indeed writing a song with our lives and while we are all unique in our songs, we all sure can relate to each other and the problems we all have that are similar but different. Sometimes the success of a song really depends on how well other people can relate and incorporate the words of the song in their own life.

Many of you know me more for standing up for the Constitution's Principles, especially the natural born Citizen clause required in the Office of the President that I filed in Court as a matter of record in 2008 and 2012 and now 2014 in Judy v. McCain and Judy v. Obama. The principles in our Constitution are important and using them as a guideline and direction really has kept us out of a lot of trouble.

Of course when they are violated the consequences are seen also and we pay for them in much the same way as you would buy something that was very expensive. Mistakes in our lives are costly. Of course we all hope we can learn from our mistakes and do better, but when we don't learn from our mistakes often they are repeated in our life and that can be said of a whole country also.

American exceptionalism is a strongly debated topic. Many say America is not really number one at anything when you start looking at the numbers and manipulating them. Defense and protection is very important when you have a tyrant at your door wanting to dictate terms on your life. That is where our Constitution becomes real as a set of guidelines for the liberties and freedoms we have agreed upon as law.

Of course some lawyers and elected leaders might say 'law' is really only what is actually enforced. Meaning for instance when you have an unqualified person in the Office of the President, he stays there unless the law is enforced that says we require as a qualification a natural born Citizen, "Born in the U.S. to Citizen parents" which of course is the sensible application of the law to avoid a foreign influence at the head of our armies and military.

When Congress debated this in 2000 the testimonies were really interesting and reflected that something amazing happens in a second generation American that does not necessarily happen or is not necessarily felt through the veins and heart of a person as a first generation American that is poignant or pervasive so the qualification has not changed even though it has been considered fairly recently in our own history. Most Americans probably have no idea what was said in those hearings and chalk it up to 'trusting their Representatives' with a comment like, "That's their job- That's what we vote for them to do".

Elected positions are not really so much about popularity contest as they are a 'trust' to do a job, much the same as if you asked your son to go to the store and buy a gallon of milk and hoped and trusted he would come home with milk rather than a bag full of candy. It seems simple enough, but often it becomes a regrettable circumstance and our elected leaders come home with a bag of candy to rot our teeth out instead of some milk to fortify our calcium intake that will strengthen our bones.

Well, my point here in this blog piece was really to say that standing up for the Constitution for me is as important as my music and both are reflections of my own heart. I can't see laying either of them down because they are both apart of me.

I don't write my songs because I think they will be big hits. I really don't. I write them because that's what I have coming through me. I don't take a stand for the Constitution or run for political office because I think it would be cool to have my picture taken with other foreign heads of state. I take a stand for the Constitution and run for political office because I understand how important those principles are for the people in our Country and a Country is really defined by the people, otherwise the value is maintained by the animals.

As soon as we lose appreciation for the principles of our Country's Constitution we really become an oppression upon our Country seen as something worse than the animals for at the very least they aren't oppressing nature but are abiding within nature's laws. I know that's kind of heavy, but there are truths that can be recognized with in it if one has a mind to look for them.

One song doesn't define me, I've written over 60 songs. Trying to pin me down to one song is certainly denying the other 59 in so many words. You can do it, but it doesn't hold all that much water. I'm certainly more than one single song and I'm more then one day in my life or one period in my life.

I do feel quite misunderstood often about much in my life and I've done quite a bit to try and open the box that many people would try to cage me in and label me as so as to do my part in helping people understand me. There are many who try very hard to keep me in their little box. They spend quite a considerable amount of time seeing to it I'm kept where they think I belong.

As I reflect on this 'effort of theirs', I have to ask myself why? Why do they do it? The answer comes back with the definition of 'fear'. They are afraid of their own reflections if it is discovered they are oppressors or in other words, trying to maintain me in their definition and little box. This is the action of a 'cover-up'. I do not try to cover them up, I'm not anxiously engaged in suppressing their music, or suppressing their 'likes' or 'hits'. I'm not even in the position to entertain doing that,but they are.

I am well aware of this effort of 'cover-up' and 'containment'. It happens on the Internet. There are interest, some might call them 'special interest' because they are a reflection of individuals who have planted the seed, nurtured it, and seen to it that it has grown. There efforts are not valiant, honorable, or beautiful by any stretch of the imagination or definition of the words. They are corrosive, corrupt, and disingenuous in nature. They do not reflect any appreciation, but reflect instead bitterness, fear, and contempt.

Its not my job to change them. That is their own song and I shall not hinder them from making their own song. My job is to give to you my songs and give to you my heart., for that is what I have to give, and for that I am grateful to be able to give you something. Yes, there might be quite a few things wrong with it and it might not be satisfactory to you because of this imperfection or that imperfection, and your certainly able to trash it.

What I am thrilled about is that there are people who love it and appreciate it. I want to say thank you to them and this message is to them for sharing, caring, and loving me. I love you for that reflection and I hope to reflect that love you've given me back to you. Its a lovely process. (smile) Its not that I can't improve either, or that I haven't improved from days gone by. Day by Day, here a little there a little, I don't think there is any one of us who wakes up one morning and things my goal is "not to improve" is there?

Even in our tragedies, sadness,and bitterness we are seeking improvement. With that I want to thank you for all you have done for me. Each and every one of you, critics and collaborators alike. I don't believe you would criticize without caring in some ways for me. I recognize this. My own mother is my worst critic and justifies it based on her freedom to do so. I do not think she does not love me. My own father, God rested his weary body also was a great critic of me falling on my face. If I can take the harsh criticism from my own mother and father, I can surely take yours with some ease.

As we look upon our lives as vehicles often times driving a sports car is not practical on a bad snowy day where an SUV is so much nicer, but we all recognize a sports car is in many places pretty cool and fun. Every star in Hollywood has bad snowy days when they wish they were home driving the SUV before they turned into the sports car. Maybe that's were shape-shifting is a good thing and those who can do it and don't depend on just one certain vehicle are better off in life's changing roads and climates?

I've never depended upon being elected, neither have I depended upon my songs making a living for me. I am more than being elected, or being a one hit wonder and so are you. I want you to believe that and trust it because its the truth.

With that I want to thank everyone who through invitation, came to the private debut of my new single, 'I'M FEELING A NEW LOVE'. It was wonderful! I cherished each and everyone's compliments and have tucked them away in my heart to treasure the rest of my life very sincerely. You came, you listened, and you valued the gift of my heart to you. That means the world to me and is a buffer for being burned, quartered, and trashed. (smile)

You my friends are a joy to me and enrich my life. I could only hope to be some small smile in your lives and hearts.
