Addressing How Trump slid in on a Stealth Civil Rights Action

Wednesday November 9th, 2016, Democrats woke up in a cold sweat seeing President Donald J. Trump had won Election 2016. How could that possibly happen on the heels of two terms of popular Obama? What had they missed? How were the polls, pundits, and inside Washington DC'rs so drastically wrong? How had Donald Trump slipped in on the Civil Rights Action America had propagated so faithfully, with identity politics so strong with minorities and women? How had Trump attracted so many Democrats away from the Democratic Party to get the steering wheel of the Office of the President? We Democrats are left to examine these questions and ponder them as a very minor party, humbled and reduced to ashes as more than 1000 offices have departed the Democratic Party across the Country in the wake of the ObamaPopulism.

The whole idea of being an "insider" is being part of an inner circle that the masses are not part of. How rare is it when the inside of a nucleus becomes unattached to the outer circle thereby rendering it on the outside while the outside become the inside? That happens when things get turned inside out. You hate it when you get caught wearing that sweater with the tag hanging out? Its' embarrassing when you put your shirt on inside out and go out in public. Most of us can identify with that having done it on occasion, especially when we are in a hurry or rush.

Civil Rights in Washington DC is set in Stone and Granite. There is no way anyone can not gaze upon the Washington, Lincoln, or Martin Luther King Jr. Memorials and not think of an outstanding struggle of independence, freedom & liberty, all of which encompass Civil or political rights.

Some might say Political Rights are different then Civil Rights, but they would be mistaken. One might ask with the Amendments of the U.S. Constitution that enabled voting regardless of color or gender, with the advent of same-sex marriage upheld by the U.S. Supreme Court, and Pro Choice, if there are any Civil Rights left that encompass large swaths of a percentage of the population in America and how when those become law the Conservative Path does not pick up an advantage of that law the same as liberals do?

This is part of how Republicans were able to benefit from representing themselves as pro life and pro choice, for marriage between a man and a women as well as same-sex marriage. When it a Civil Right goes through the struggle to become Law upheld by the U.S. Supreme Court it is much less likely to ever be over-turned and because of that, both Republican and Democratic Parties are able to Claim the Law will be upheld and thus attract the one issue voters.

Democrats would no doubt in many instances like to stash and tuck away the line-item Voter in a singular little box, but when it becomes American, there is not much luck of turning it back. Can you imagine the struggle it would be to outlaw black men or women from voting? Can you imagine turning the clock back on same-sex marriage? Neither can Republicans and President Trump was able to gain a foot hold by stating as much, yes I'm pro-choice but I'll uphold the Law.

Trump with such a statement gains all the Pro-Life people who think of the sliver of a chance that abortions will become illegal by turning the issue back to the States, but the reality of any State of the Union making abortion illegal would undoubtedly suffer the frenzied focus of the media Nationally and render their U.S. Representatives and Senators pariahs.

When it comes to the National Focus, there are not a whole lot of U.S. Representatives or U.S. Senators standing up for the repeal of the 18th Amendment which would effectively make prohibition legal again. You don't see these same Elected leaders standing up and forming coalitions to repeal same-sex marriage, or repeal pro choice Law. So the Law when it is passed finally or actually becomes Law is also claimed positively by both the Republicans and the Democrats.

Now this poses a bigger problem for the Democrats than it does the Republicans because they have swam in identity politics for so long - First Black President 2008, 2012, First women President 2008 2016 now they have lost to President Trump one time it may be over for Democrats as far as Civil Rights and the High Ground of a moral civil or political high road cause that will propel them with enough votes to gain the favor of America back which has been lost.

Let's face it Democrats, this is why we may say now days especially  very rarely does a Civil Rights Argument come along that will unite the People of the United States of America nationally.  It would take a current civil right infringement that affected everyone nationally to rekindle favor. The Parade in a low turn out of 500K women when 1M were expected began in Washington DC today. Those women representing any pro-choice advocacy were excluded by the organizers whittling away at women as a bloc as fast as they were trying to organize as a bloc.

 The female temper-tantrum has at the center of it's complaint Trump's Freedom of Speech or 1st Amendment Rights which they are exercising very raunchily themselves. What Trump has said bothers them,but he is now their President too.

I always thought women really did bring out the best in us men tempering down the testosterone rich and raunchy foul mouth natural instincts of men in a higher class of smoothing our rough edges. Therefore to see and hear what was happening at the Women's March was in my opinion something like wanting the worst? 

It's probably safe to say most of the women protesting today were Democratic Party women as it was organized as a protest against President Trump. I don't say Temper-Tantrum lightly because I know what it's like to feel threatened and be threatened on a basic Civil Right. But I would like to focus now on a couple of things that make a make a temper-tantrum just that verses making a Protest on Reality something of a Civil Rights Act and it's based on action and behavior being much bigger than words.

We Democrats have lost our way with the Leaders I believe. Trump slid in the drivers seat of the Office of the Presidency as a soft Dem. I'm not sure if Dems can come back now.. it's gonna be a lot of work if they do. Reflecting on Trump's inauguration speech I heard many things that sounded like Democrats

1- For those forgotten you will be remembered. (Have Democrats forgotten about people in their exclusion of inclusion stance represented to the National Psyche the last few elections?

2- Jobs will come back (How big of a part have Democrats played in employing the world over their own constituents as they have been encouraging exporting jobs for lower wages in our big corporations rather than remembering the little guy back here in the USA?)

Dems forgot those main stay principles as they considered the World first the USA second. Donald Trump seized on these and employed them as certain realities that were very lifelike in the homes of so many Americans. It's hard to deny the rust bust in American factories riddled across America? Obama seemed happy to encourage this departure of employment at the same time opening the gates to disgruntled immigrants in places he was bombing. Things Obama as well as Hillary Clinton forgot:

1-The world doesn't pay taxes here
2-Nor does the world vote here

The Dems needed to soften on their anti Nationalism and remember we are part of the World but we are not the World. Do you remember how big of a deal Obama was made out to by the Press as he dropped in on a July 2008  Berlin Germany Rock Concert attended by 200,000 people?  The U.S. was being sold a bill of goods by the popularity reported of the World's Attraction to Obama.

[For the man who has brought rock-star charisma to electoral politics, today saw the campaign rally as pop festival, a summer gathering of peace, love — and loathing of George Bush.]

Obama has, in hind-site, fueled an undisputed eight continuous unbroken years of a constant state of war for America Democrats. He dropped a total of more than 50 thousand bombs over his last two years. What part of George W. Bush can we realistically say we missed in Obama? Was it the 7 Nations Obama bombed verses the 4 George W. Bush had? Does another 10 Trillion in National Debt selling out future generations whole futures for interest that is questionable to American's defense sound familiar? Was it the fact Obama could Open his mouth as a black Democrat and sell more than half the Country the lies 36 times about keeping their doctor, the 41 prisoners left at Gitmo as Obama sails off?

Salivate all over yourself if you'd like, but Obama forgot about the common man and Trump took notice. Democrats were thrilled with the adulation of the world but were blind to the hurt of every day working Americans. Washington DC did exactly what Trump said they did. They were out-of-touch with realities and they also missed the biggest Civil Rights Action that affected the Nation over the last 8 years, and that was Obama's ineligibility by the Standard of the U.S. Constitution.

How could a black man violate Civil Rights? The concept seems incomprehensible to most Democrats who will throw down for Obama as a Citizen but forget the qualification for the Office of the President in [Citizen] stopped for those born after the Adoption of the U.S. Constitution and from there on out required [natural born Citizen] ie. born in the U.S. to Citizen Parents. 

It was a stealth civil rights issue Trump say and capitalized on in America. Most Americans across the electoral college agreed, but Democrats refused to see opting again for populism and slandering pejoratives like 'Birthers'. The Democrats ignored, excluded, and castigated those who were suffering for the Civil Rights of a fair and equal presidential race under the Standard of the U.S. Constitution which is not the standard of the world.

That is why Democrats are so angry right now. They haven't yet come to grips with the fact that the future of the Country has been handed to Republicans who did not hold a single hearing against Obama's qualification.

Republicans did not have a single main stream Candidate willing to take a stand in Court filing a Civil Rights Complain of an unfair race in Mitt Romney 2012 or John McCain 2008.

Republicans have far more ineligible Presidential Candidates on the Bench or who have ran for President but who do not satisfy [born in the U.S. to Citizen Parents]

See U.S. Supreme Court Case Minor v. Happersett for precedent of [natural born Citizen] ironically the first case recognizing women as equal citizens to men. Celebrate that infringement in Obama women of the Parade in Washington DC. 

“…all children born in a country of parents who were its citizens became themselves, upon their birth, citizens also.”  First, the Court states that these persons are “citizens”.  But then it makes a second statement about this class –

2. “These were natives or natural-born citizens, as distinguished from aliens or foreigners.” 

As a Candidate for President in the Democratic Party the only one to also sue McCain and Obama clear to the U.S. Supreme Court twice 12-5276 14-9396, Democrats have missed a Civil Rights Fight that Trump actually got credit for as being a leader in the Birther Movement. Trump even tweeted to Cruz he had standing and could sue him. 

I protested Obama's Election clear to the last day of his illegal occupation in the White House as a defacto President. Obama did not run a fair and equal race under the Standard of the U.S. Constitution and it has affected negatively every American deeply. So deeply, they turned to someone who in word represented exactly that, though Trump failed in action to file any paper officially.

President Trump Tweeted he had standing and could sue Ted Cruz.

Obama is not in the White House any more Democrats and I suggest that you reconsider your official Civil Rights backbone in understanding we live in the United States of America. We have a Standard of that to uphold when we elected a President of the United States. I hope Democrats will soften their stand on Nationalism as it applies to our freedoms and liberties.

The Constitution will get in your way if you do not Amend it properly. The Nation was saved by the U.S. President's two-term limit, as well as the Electoral College Vote and Democrats will never over come those two things so they might as well uphold the Constitution's [natural born Citizen] Qualification too.

Even the New York Times recognized that the U.S. Supreme Court was faulty at Hearing and upholding Minor v. Happersett in the face of the Obama's assault on Civil Rights.

The reason Cody wants you to understand that the Race for the Presidency is a really tough marathon race is because of the Standards of the Race that are defined in the U.S. Constitution have been something he specifically has stood up for with the standing that is represented by competitors in the Race.

Throughout the relatively young history here in the United States of America we have seen many different Civil Rights movements. The nefarious brutality that occurred in this country at Pettus Bridge in Selma, Alabama, happened the year I was born in 1965. The same year color television arrived on the major networks regular programming, Malcolm X was killed, and the first American troops arrived in the Vietnam War,LBJ signed a the Voting Rights Act and an immigration bill that abolished quotas based on national origin, Mary Poppins took home 5 Oscars and Iron Man (Robert Downey Jr.) was born.

The United States of America had fought many civil rights battles up to that point, including the Mormon Extermination Executive Order 44 1838,the Civil War was fought in 1861-1865, in 1868 the 14th Amendment was signed, in 1870 the 15th Amendment was signed granting the right to vote to those regardless of race, color, or prior servitude.Rosa Parks refused to give up her seat on the bus in 1955 leading to buses desegregated on Dec. 21, 1956. In 1960 President Kennedy issued Executive Order 10925, prohibiting discrimination in federal government hiring on the basis of race, religion or national origin and establishing The President's Committee on Equal Employment Opportunity. January 23, 1964 the poll tax was abolished by the 24th Amendment making it difficult for blacks to vote. In 1969 President Nixon signed the Philadelphia Order" presented "goals and timetables" for reaching equal employment opportunity in construction trades. In MARCH 22, 1988 Overriding President Ronald Reagan's veto, Congress passed the Civil Rights Restoration Act, which expanded the reach of nondiscrimination laws within private institutions receiving federal funds and in 1992 Affirmative Action upheld the University of Michigan Law School's policy, ruling race could be one of factors colleges consider when selecting students because it furthered "a compelling interest in obtaining the educational benefits that flow from a diverse student body.

What happened in 2008? America elected with the help of the Mainstream Media the first ineligible person to the Office of the President who they called "Black",even though Obama was noticed half white and half black on a long form birth certificate that was riddled with forgery and fabrication depicting his father as "African" rather than the term "Negro" that was used in 1961. Malik Obama, who is Obama's half brother stated recently in an interview with Joel Gilbert that Obama was not his half brother or a true son of his Kenyan father in an interview and even offered to take a paternity test and stating Obama is not an honest man.

Standing laws demand, and Obama's lawyers confirm, a Presidential Candidate is really the only person that can show harm or damages fulfilling what is called Standing but no where in the litigation history noticed under the wiki term Barack Obama Presidential Eligibility Litigation is Judy v. Obama mentioned, although it has two United States Supreme Court Cases now, and is referenced in the Georgia Litigation and New Hampshire Litigation only under the attorney's name who represented briefly the matter.

In fact, in Wiki the Georgia Case cites "Carl Swenson and another Georgian" as well as Taitz representing "A Georgian", why has wikipedia deliberately left out that there was a Presidential Candidate represented in New Hampshire and Georgia as myself, Cody Robert Judy? This shows you Wikipedia is involved in a big cover up and that involves the public who contributes to it who either won't really investigate or deliberately is withholding evidence from being understood.

In the 2014 released movie SELMA, also last week released on Redbox, it is very accurately depicted that though the Civil Rights Act has been signed in 1964 Blacks were blocked from voting by other means. Oprah Winfrey playing the part in the movie of Annie Lee Cooper is shown filling out the voter registration form, then being further harassed. She's asked to recite the preamble of the United States Constitution, when she does that successfully, she is asked how many County's there are, when she does that successfully, she's asked to name the Judges in each County which she cannot do and this substantiates the "DENIAL" on her voter registration form.

The brain storming meeting depicted with Martin Luther King Jr. and his Group of Civil Rights leaders states the hardship of Blacks by first having to have a registered voter vouch for them, so they then could fill out a registration form, pay the poll tax, so they then can be forced to declare their address where retaliation can then be concentrated by white officials, who own the Justice Departments because you have to be a registered voter to qualify to be on a jury. This shows the deliberate manipulation of laws in order to lawfully do what was wrong. This is in fact happening today only in favor of Barack Hussein Obama, Ted Cruz, and Marco Rubio.

Marin Luther King Jr, declared that they would demonstrate, and march, and disrupt the peace until justice is specific enough to afford the rights of individuals to be protected by the law and the purpose of the laws were fulfilled. The dereliction and obfuscation of my rights as a Presidential Candidate are exactly what we are seeing today turned on and having blacks turn on me and my rights based on something that happened before I was even born. Many Blacks today we are seeing in looting riots and burning Ferguson, Missouri and Baltimore, Maryland are in fact doing the same thing the Whites were accused of doing in 1964. What this proves is that knuckleheads exist in every race to do the same kind of damages against the law that then require a constant vigilance necessary in every generation to stand up for the law.

Does equality include making white people suffer the same damages that happened upon black people until such nefarious acts add up to require legislation to prohibit such? Since when does the prohibition of discrimination upon "color" not include the color of "white"? The same evil actions that discriminated against blacks can also be used to discriminate against whites and if we as Americans have come anywhere we have to recognize this or we provoke a racial divide that is really un-American.

You know I sued Sen. John McCain first on his ineligibility because he was not 'Born in the U.S. to Citizen Parents' and it was only later that I included Mr. Obama. I think one of the things white people are not used to is having to march and stand up for their Civil Rights which are in jeopardy now from a black president who is ineligible, unqualified, and unfit for the Office of the President by the standards of the Constitution and who was elected but only upon the fraud and fabrication of his identity which constituted a lie. Martin Luther King Jr said and it was depicted in the movie Selma:

"We all bear a responsibility. When will we be free soon, and very soon because no lie can live forever"
, that includes Barack Hussein Obama's lie and fraud committed upon every voter in the United States of America that directly damaged my Campaign for President in 2008, 2012, and now is still doing damages by taking necessary monies away from the Campaign and forcing us to act in the civil courts of law to invoke Justice and make known the lie that has been wickedly formed against We The People.

When does black or white people's actions constitute a violation of our Civil Rights? When those actions perpetrate the laws established by We The People under our United States Constitution. Without the Untied States Constitution where are black people today? Why then does any black person today not respect the Constitution's demand for a natural born Citizen in the Office of the President (born in the U.S. to Citizen Parents) unless they have themselves become the Masters of the whip and a movement of civil rights violations?

Have we not spent millions of dollars, even trillions of dollars on wars under Barack Hussein Obama financing the Arab Springs, financing the states of Afghanistan, Iraq, Libya, Egypt, Syria, Yemen, Ukraine, but do not have the moral courage to defend Civil Rights in our own Country?

What gives you the right to kick and beat a man whose unconscious lying limp on the floor unless you are evil? What gives you the right to deny evidence to a man that would afford his release from prison while the denial of that evidence substantiates your own dilapidated civil rights frame of mind and protects what you call the integrity of your church? When do we march for Civil Rights in a manner that is productive to the integrity of the laws that are already on the books? How important is it that the U.S. Supreme Court hear Judy v. Obama 14-9396 that brings to the Court the legal investigations that prove Obama's identification is a fraud, declare that he is not a 'natural born Citizen' qualified for the Office of the President, by a Candidate for President who has been run over and trashed because of his disregard for the Constitution of the United States?

You know people wonder why I haven't been elected while I've run for office six elections? Its because I have run in all of my election races, for Congress for the Senate and for President in an overwhelming majority that did not respect or honor the Civil Rights of our Untied States Constitution. Indeed they said they did, but their actions were much the same as those actions we would compare to the perpetrators of Civil Rights you'd find opposed to equality.

Obama is opposed to equality, his desire all stems from a root of superiority, if it wasn't so he would have never run for President and had to doctor his identity to commit fraud upon America. Obama has done more for devastating and undoing black America's gains of the last century then any single person. Obama is not all blacks in America. He is one single person who doesn't think he has done any damage in the wake of his own disabling Civil Rights machinations. Indeed, he thinks that without any United States Constitutional Amendment expressly declaring a change in the requirements for the Office of the President, that suddenly despite the failed attempts to change such in the Legislature eight times since 2003, it changed and those requirements of Citizen for U.S. Representatives and U.S. Senators suddenly meshed with the Office of the President's qualifications of a "natural born Citizen".

That is an action of superiority flying in the face of all Americans and disgracing all colors from white to black. Obama is an embarrassment to Civil Rights and his speech at Selma, Alabama this year is an abomination to the struggle and fight for equality in the Civil Rights movement. Obama's place in history is as Martin Luther King Jr. expressed to President LBJ Johnson, being destroyed by his own actions.

Obama's own foul eminence has clouded his vision and people have thought if you just threw enough money at it that it would cover up the stink, but the action in Judy v. Obama 14-9396 declares to the Justices of the United States Supreme Court that the law is plain and simple and while many distractions have been used to shift the focus away from the 'natural born Citizen' clause of our Constitution by stating that the term 'Citizen' was analogous to 'natural born Citizen', the Constitution's own use of Citizen at the time of the adoption of the Constitution declares a time constraint upon that term that expired upon the death of those born at that time.

Prohibiting Foreign influence was the objective of creating the qualifications for the Office of the President that was progressively stricter in age and time than Representatives and Senators. Just like the objective of 15th Amendment was designed to create the right to vote regardless of race, color, or prior servitude in 1870, there was still so many hurdles and technicalities that were imposed upon black Americans they could not vote in the South until 1964 and 1965 Voting Rights Act came in to force, so that justice could not be skirted. Obama is skirting the laws and has used the same tactics to avoid the justice that matters to all Americans. Exposing this to the light is what is necessary for Justice to prevail and the poisonous lie to be neutralized.

THE DISCOURAGEMENT OF TIME

The discouragement of the time it takes for justice's wheels to roll around for Justice has taken a toll upon America. Indeed 10 Trillion Dollars has been added to the debt upon American's backs by Obama whose lash and manipulation of the 'natural born Citizen' clause is just another parallel to the facade of the unemployment numbers not counting 93 million Americans dropped out of looking for work or the unemployment benefits to make the national 5.6% employment numbers look legitimate. This is the tacit illumination of an illegitimate occupier of the White House as a puppet of Wall street wanting you to stay in their Market and heep the pile of lies higher and higher.

It will not become legitimate with time, and neither will Obama. A lie does not last forever, the eternal value of the lie has an expiration date with the Truth.

The accomplishment of The Betrayal Papers is a literary standard of excellence as I’ve read them. There is no doubt about that.

Tis sad I’m afraid that history will pulverize them as it seems clear the weight they have given, (minus the 6th and final yet unpublished that might change the narrative), to association by social influence has drowned the tribute to U.S. Constitutional Eligibility and the Qualification of honor in the Historical American Mountain found in our U.S. Constitution referenced by many more in historical context.

To minimize that which should be capitalized is literary error in context. While I do not know all of the folks credited I do know and think highly of Mrs. Sharon Randeau for her tenacity and courage to stand in her Publication for Principle over political party.

The same cannot be said with the widely circulating and read Article “Why We must Unite Behind Ted Cruz” published May 4th, 2015 by another author credited to The Betrayal Papers Mr. Trevor Loudon.

The sanction of Cruz for President neither born in the U.S. not having been born to two U.S. Citizens is the adoption of Betrayal that very well could provide fodder to blasting the BETRAYAL PAPERS into an icey Potomac.

In fact if association in social circles is weighted and highly valued over the U.S. Constitution’s Qualifications for the Office of the President, which is the entire purpose or subject of The Betrayal, how could one possibly not investigate Cruz’s Fathers voluntary enlistment into Castro’s Communist Revolution?

Sure he may have been imprisoned for a year to make it appear asylum was necessary but was it escape or convenient release of a mole?

A mole whose son managed like Obama to be a Harvard Graduate, Constitutional Professor, and First term U.S. Senator Candidate for President.

Given the similarities the association credit valued here in the BETRAYAL PAPERS, it seems Sen. Cruz’s story is the same but being adopted as a BETRAYAL and that adoption by those authoring these articles is every bit as unworthy the stand for Principle enshrined in the U.S. Constitution.

In fact, as the only Candidate For U.S. President who has a Record In U.S. Federal Courts against both McCain and Obama for failing the “Born in the U.S. to Citizen Parents” test for the natural born Citizen requirement, the only name author credited to The Betrayal Papers that has offered her talents in promoting a Judicial Branch intervention of the Legislative and Executive Branches muddied road is Ms. Randeau and Ms. King.

If the subject all the authors contributing their reputations towards be so vital, why then is the solution and only Candidate able to withstand the Racist Element of this Toxic BETRAYAL so undercut by all those involved?

The answer to that question is about the only mainstream mention these papers are ever going to get unless the Facts change.

In mentioning the The Betrayal Papers I do not mean to discourage whatsoever what Citizens can do, what they will do, and what they will yet do. I merely call to the attention that those who have the means should use those to file an Amicus Curiae in Judy v. Obama 14-9396 supporting the Constitutional Demands with a steadfastness that even I have kept up this long while. Discouragement is easy as time has gone on, but this poison and venom that infiltrates the body politic is indeed our concern if it threatens our Republic, which in this case it most certainly does in both the Republican and Democratic Parties Legislative Bodies. The concern is left to the Judicial Branch as a matter of Civil course as the Executive Branch is usurped. If our check and balance system does not work we have already slipped into and become a State of violence.

The STATE of VIOLENCE

The withholding of the Truth that is meant to cover the lie that is Obama, charged as an agenda to the Main Stream Media by the Network Moguls , has effected me and my Campaign in profound loss and damages. They see it as a casualty of the campaign elections rather then an American Civil Rights violation that demands justice. The spill over from the civil arena to the violent arena has already begin to infiltrate the general population and it will not be spoon fed like a baby the Civil Rights movement that once was. For we have been down the Pettus bridge before and we saw the police brutality that occurred. The cheers of the hundred or so white folks as the innocent were run down and beaten.

What you have not seen is the brutal beating the Mormons perpetrated upon my own person twenty two years ago as a result of the lack of communication by the Leaders who owing to their own reputation refused to give up the video tape of such for my defense. This went to the United States Supreme Court and was refused based on the fact that it doesn't happen very often. In other words, the casualties of running over people are acceptable? Has the gunning down of black people by the police become acceptable? Why would the brutality upon white people then be acceptable? Violence often stems from a lack of hope. Its is the fundamental bridge between the paths that are chosen and yes they are chosen.

In that videotape withheld as evidence from me you don't hear 100 people cheering about the violence as you did at the Pettus Bridge, you hear 17,000 cheers! The same cheers continue and are heard after the beatings and horror as you heard on Pettus Bridge in 1965 today as protesters turn violent because they feel appealing to the bodies in politics does not change anything. Protecting those who in their ignorance assumed the worst based upon that lack of communication by the leaders to the people that lie a trap and commit a frame job has still not been told and those responsible for kicking and beating unconscionably a person you see is unconscious is a horror upon the dignity of the whole assembly.

Protecting the perpetrators of violence by any means necessary seems to run in accord with the wickedness of evil intentions as instruments of violence rather than peace. That wickedness exist in every single one of us. It is not just in those who are captured on video tape. The collateral damage to my own Civil Rights is acceptable to these leaders in the Legislature, and is not spurned by the Media who is owned by drama of course. Justifications of the violations of free speech and our 1st Amendment in a Church meeting is immediately seized upon for violence,unlawful prosecution, and illegal imprisonment happening in America this very day.

I am witness to asking and pursuing peace every single day from those who have lost their hope, lost their dignity, and lost the will to pursue justice. There are many who have completely lost the will to support my Candidacy, to protest, to March, to demonstrate peacefully because they have indeed lost hope anything will change. They are indeed preparing for a state of violence based on a loss of principle they see as not being restored. That is the hope that our elected Leaders have stomped on, tapped down, and ground into powder. The borrowed time we have is in this last chance in the United States Supreme Court. If this is lost, our Republic very well could be lost to a State of Violence. It is very serious when the pleas for peace and civil rest give way because an ineligible President has assumed his seat as a usurper and a naked emperor strutting down the street. Yes, he has the pen, he has the office, but a lie will not last.

This much is true, the truth is on our side. The grapes of wrath are stored and the violating atrocities are not gone unnoticed by the God in Heaven upon all people. Just as the truth of equality can nourish, the deprivation of truth in the lie can starve a people, can withhold the rain, can scourge the financial markets,can encourage and embolden the enemies, can disrupt the ground, and turn the world upside down. Justice has a perfect way and the days of truths imprisonment can come to an end in an instant, while the lie is called a reprobate.

If your heart is like Pharaoh's of Egypt's who hardened his heart against God and his prophet Moses, the record is clear God has a way of softening that heart but my plea is that you don't wait for the plagues of God to be unleashed. That you will ACT now, today, in doing all you can do to see to it that Justice is done and met as a standard in righteousness of that freedom and liberty we have been charged to defend. Freedom and Liberty is not a token you play a video game with as so many of our fallen heroes have demonstrated taking down thousands before they went.

In a game of Justice, God will clean the house and you may witness the ground upon which you stand open up and swallow you up taking you to that hell which you so richly deserve and have in your actions 'hoped' for. The spirit of God manifest itself in ways all around you and if your happy with your life you have nothing to fear. But if you have acted your life in a manner of supporting injustice, corruption, and unsavory damage to the Republic for which we stand, and do not change, the peace and tranquility you have disrupted will crawl up your spine and enter your mind.

We have just about done all that we could do here. Our Appeal has come to the highest Court representing justice in the damages that are done, representing the laws that have been violated, representing even the corruption of the body politic. We do have a hope to clean the house. This is a hope that we have and I encourage this hope be upon you and that you do your part to give and share this hope to others. This 43 page writ of certiorari for the U.S. Supreme Court has been read an astounding 3,142 times by the brightest and best legal minds of our Country over the last month and I'm sure more than two are current Presidential Candidates who thought instead of standing up for the law, they would try their hand at skirting it. To those I would say 'do not trust your Republic with such, and remove yourself from their following', and ask, "Why would you follow someone who hates our Republic, unless you yourself are a traitor to the Republic?".

This issue and principle has to become black or white, and I'm not referring to skin color, but am referring to clarity and a line that is drawn in the sand. Your either for usurping the office of the President or your against. U.S. Sen. Rand Paul who declared he was not for Republican or Democrat Birthers, has chosen to be for the usurpation of the Office of the President. That makes him unfit for command and of an unsound mind and spirit. If he will yield that ground what hope have you of maintaining the high ground?

So you must choose from the list of leaders with their hat in the ring most who have been elected who you think will protect our Republic. That is the job of the President you know. To preserve, protect, and defend the Constitution of the Untied States. I submit my own legal and civil actions have protected and done this job for the last six years much better than any of their accomplishments in office. In fact, I have been doing the job they were paid and hired to do. Yes, they have let you down. Haven't uttered a word or raised a hand in objection while God in Heaven has witnessed the murders of so many innocent victims to Barack Hussein Obama's usurpation and fabricated identification.

Are these murders known as Obama's dead pool, all of course to cover-up the lies, causalities acceptable to the course of our elections, and when oh Lord will enough be enough?

A Dark Horse in the Race for President 2016 Defends Police

The 2015 riots in Baltimore, Maryland that have stemmed from what began as peaceful protest for an individual who was in the act of committing a criminal violation of have cultivated a seedy call from Al Sharpton that the Department of Justice needed to take over all local city and town Police forces. I don't think there are to many people understanding 'police violence' in a deliberate maleficence of going after a subject resisting arrest, failing to stop, or as this case may be 'evading arrest on foot'.

One very sad element about this so many people failing to quantify the Crime committed when running from the Police and we understand that as has been reported a preliminary test of the subject of protest has tested positive for heroin and marijuana and that the police were witnessing a possible drug transaction. While none of these offenses have the 'death penalty' as a criminal penalty, it should be widely agreed upon that when you run from the police you not only put yourself in jeopardy of losing life, limb and property, but the lives of others as well in many instances are also brought into that circle of death and injury, from a wide variety of circumstances that erupt from that decision to flee from police.

Don't act as if I don't know, because I do. Been there done that.. But the chances you take of serious accidents happening in the process of running from Police put yr life on the line as well the life's of others. Everyone knows that or should know as an adult or a juvenile. A new 2m:52sec video on the FB Police Training Page circulating the internet is very perceptive in articulating exactly what a 'small' problem that has gained such a big audience and is further escalating concerns of a politically motivated agenda that could even be linking back directly to Obama in his own fear of being convicted as usurper unqualified by the Constitution's demands for a 'natural born Citizen' as well as being a conspirator of knowingly handing out or using fabricated identification documents to gain public office.

I've been charged with a Class C misdemeanor for running, and suffered the consequences. My determination for justifying running was not considered relevant in Court but did serve a purpose of indemnity as you might remember the movie The Fugitive did in his pursuit of justice to clear his name rather then have it particularly scabbed by the Media out for a story that sells newspapers. Indeed false imprisonment and unlawful prosecution exist and where ever possible are subjects in need of Justice equally.

Evading arrest on foot (sometimes called flight) is committed by knowingly running away from an officer to escape capture, detention, or arrest. While many of your comments reflect bad on Police, none reflect badly on the 'element/action' that got police pursuit and attention in the first place. We all know peaceful cooperation and respect under normal circumstances and following orders of the police are generally the safest way to stay healthy. This is not what I would call truly pathetic. What is very sad is the way one protester put it: "We demonstrate peacefully no one pays attention; we burn a city everyone pays attention.", but is that attention the kind of attention you want and does it serve a purpose?

While American Pharaoh is favored 3:1 in the Kentucky Derby being run today, which is a lot more exciting then the Presidential Race of 2016 at this time, we as Americans really need to watch the Pharaoh's of our society- Those who would not respect our United States Constitution and the qualifications of the Presidential Race requiring a natural born Citizen that is very different from the qualifications of a U.S. Senator or a U.S. Representative that is written as "Citizen" as it is perfectly explained in this two minute Constitutional Reckoning Video.



As I mentioned earlier the political agenda of this escalation is indeed articulated by Al Sharpton in this quick video as he mentions:
[“That’s why we’re going to do this march from here to Washington. We need the Justice Department to step in and take over policing in this country.” He also added that it would take fighting states’ rights to do so.]



Baltimore Maryland burning and rioting and looting was afterwards condemned by Obama, but the Baltimore Mayor said she 'gave space to those who wished to destroy'. She's is not a little ole mayor who heads out to vote Democratic Party every four years and Stephanie Rawlings-Blake is also Vice President of the U.S. Conference of Mayors and has a close connection with Obama as the secretary of the Democratic National Committee or DNC.

NEVER LET A BAD CRISIS GO TO WASTE:

Can you imagine the State Budget "take over" of all the States Police Forces by the Feds if the DOJ took over State Police? As if the Feds don't have some jurisdiction now with Federal Law Suits that can be brought against "bad policing" as Civil Rights are infringed.

This idea of the "take over" is money oriented. Just look at the Police Budgets of every, City, and Town in every State and the Feds getting into that. That Budget is what is being sought after here, not Justice. The DOJ can't handle "justice" in their own department of corruption in that a Usurper is at the head of it. Can you imagine them competently handling justice in every city and town in your State?

Indeed if this "No Justice No Peace" slogan were in fact sympathetically 'true' to an agenda of "Justice for All", as our Pledge of Allegiance is indicative of, wouldn't those who are presently advocate for Justice also be advocating that Obama is Ineligible by the standards of the United States Constitution and that those so damaged should be justly compensated for the damages in honoring justice? Indeed, isn't it in fact the mockery of Justice and the devotion to inequality that says otherwise?

If "justice" is only about the money, then you have to be rich to get justice. Those poor kids on the streets stating they want justice or their isn't going to be any peace are either simply being used or don't have the slightest idea where 'justice' begins and this is being harrowed up in the Media and exploited. Well, Obama might not agree that trickle down economics works, but we certainly see it works from the top down and that those at the bottom of the economic ladder do not get the same kind of justice that the rich often do myself included.

There is irony in the statement that people 'want elections to be controlled by the people' instead of big corporations and PACs that support Candidates with loads of cash but in the request that a candidate fund his own campaign with his own money and if he doesn't have any to mock him about it as has been done plenty to me. The irony of saying you want justice and your Civil Rights protected is that then you support a cause that really seeks to derail your Civil Rights and put an end to, once-and-for-all, your rights as citizens in the Order of making you subjects like those we might call American Pharaohs. You keep a close eye on American Pharaoh as he runs the race in the Kentucky Derby and let's see what happens to him.

Fight Over Forgiveness LDS Church Leaders & Church Owned Deseret Newspaper CEO Charged in Hate Crimes

Today is Friday the 13th 2015, I'll never forget a Friday the 13th 1993 when I was walking a long hallway with cell doors and sections down it. I thought, "Boy this seems like a bad day for sure, like I'm walking into to hell." I've tried very hard to live a Christ centered life. To not only treat others the way I'd like to be treated but also to walk the extra mile and forgive not just seven times but to forgive seventy times seven knowing I myself would fall short at times and sin in some way against my brother and that I would need to be forgiven even as I forgave.

The feeling of forgiving someone whole heartedly after they have done you wrong is a good one and it releases a burden on your shoulders. I've tried very hard to separate church and state from my own prosecution and include those principles of goodness we know are inherently good in both, as they are called for by example, in word and deed. There does come a time when you are called to fight back and when you do or when you are called to, you understand God is with you and not against you in the motive and that the tolerance of the Almighty has reached a breaking point for which you know that the seventy times seven time-threshold has been accomplished.

I was startled awake last night with a dream that The Church of Jesus Christ of Latter Day Saints Leadership and its corporate conglomerations associated with The Deseret News should be reported for the 'hate crimes' perpetrated upon me in my federally protected Campaign activity by law. I myself was stunned by the revelation being in such the habit of taking the stripes instead of delivering them as they are merited. I do not deliver the news in any kind of triumph, but rather by duty to the law and the recognition of the wisdom. I will state I have nothing but love for those of the community who are generally good practicing and faithful members of the LDS Church whom I both live around and respect for their general goodness, charity, and all around tranquility in a law abiding way to live peaceable among many differing faiths and beliefs. I am clearly drawing a line of aggression towards those so named in leadership as to the aggrieved state of my person.I am not a representative member any longer being excommunicated by the Faith in 1995 or 1996.

The incidents I related substantiating the violations of The Mathew Shepard and James Byrd Jr. Hate Crimes Act of 2009 cooperating in line with the 1969 Federal Hate Crimes Law are rooted in both the character assassination made in print at The Deseret News and physical beating I took at the Marriott Center Feb. 7th, 1993 in my civil protest, predicated today in my run(s) for President and other offices over the last twelve years in contaminating and aggravating my record.

FIRST
To substantiate this I call upon two things. Number One the video tape of the protest at the Marriott Center (The Church of Jesus Christ of Latter Day Saints, hereafter also(LDS) or (Mormon)Fireside. The link provides an attempt by KTVX to also obtain the evidence of the tape you can find at the bottom of the linked article. Also (FootNote 1)

This tape shows the assailants and is a record of me beaten and beaten into an unconscious state and lying on the floor as an attempt to kill or murder me for which I was rushed to the hospital receiving and diagnosed with head trauma, black eyes, broke or cracked rips and multiple bruises up and down my entire body including my legs, calves, thighs, arms, back, and sides.

The tape is held under copyright by The LDS Church Presidency (current). It was given by the LDS Church to the prosecuting attorney in my criminal case, shown to the Judge of my case but I was denied a copy of it, because as the 4th District Court Judge Guy Burningham, criminal case of State of Utah v. Judy, (who also simultaneously was set apart in the LDS Church acting in the office of the Church as a Bishop) told me, "They didn't want it to end up with Barbara Walters on 20/20".

I did do diligence to obtain the tape as instructed by the Judge/Bishop stating I would have to get it from the LDS Church Presidency. I sued the LDS Church Presidency for the evidence depicting the assault but was denied it in Federal Court appealed to the 10th Circuit and then to the United States Supreme Court. From the United States Supreme Court I received the condolences that not enough people suffered from not being given their evidence used against them in criminal proceeding for worry of that court, meaning my individual rights had been violated but that was just to bad.

SECOND
I was incarcerated for 3018 days, or eight point two years and that begin just over twenty two years ago. The thing which makes this so relevant today has been the continuous actions of The Desert News, a conglomerate subsidiary of the LDS Church as I will show, in a continuously crafted character assassination that fabricates and embellishes not only the incident, but outright lies regarding the prosecution and circumstances, lending a devastation to not only myself but the community at large in fear of the same bias and prejudice treatment based on actual or perceived religion as it relates to our continually evolving digital data record(s) available to anyone that searches the internet.

The Deseret News is singled out here because of a particular practice I find rather unique and which might be directly attributed to the CEO and President of The Desert News Mr. Clark Gilbert. The practice unlike other papers even within the Utah area like the Salt Lake Tribune is to leave off the "year" of the article in the i-phone review of the article. How this relates in the data search fields of the article is seen by users as if it happened yesterday and with me not twenty two years ago BUT yesterday or today.

This then acts as a prosecution of my religion every day of my life, the same as if a sign was held up around the world that desecrated my religion and persecuted me every day for it. The maximum penalty in Utah's discretionary minimum mandatory laws Utah practices sentenced me to 1-15 years. Fifteen years was over seven years ago and the Utah Board of Pardons & Parole actually held me eight years with four on parole, which was incredibly harsh for a first offense with no damages to life, limb or property and no weapon. However, The Deseret News has continually aggrieved and aggravated me over the same thing twenty-two years causing both a hardship on my employment and participation in commercial activity. To add to that, the State forgave me long ago stating I have full filled their obligation of penalty, but the LDS Church has maintained their trespassing restraining order against me even to this day, twenty-two years later. Not that I care or that they don't have a right to do that, but only to emphasize a continued malice that exist that goes hand in hand with these hate crime assertions that collaborate with the Deseret News fabricated headlines.

In fact, if you search my name this story of The Deseret News comes up in the top 5 as number 4 on the Internet. No other television, radio, or newspaper story comes up twenty two years later. The reason for this could be that The Deseret News runs the story as if it happened today with no year attached to the story itself, and represents a 'hate crime' of bias and prejudice against my person that is contrary and in violation of hate crimes laws regulated in particular of this incidence in the frame of "Religion". I also believe the story has been updated to include my middle name in particular since I have been running for Federal Office, which accommodates an active and willful prejudice and bias to do me, and my reputation harm in the federally protected activity of running for office in elections of the population, substantially creating a serious national problem. This warrants the FBI's investigation and a federal grant to accommodate that.

The Hate Crimes perpetrated by these actions are collaborated by the binding ties of the LDS Church Presidency & Twelve Apostles and The Deseret News President Mr. Clark Gilbert as are illustrated in the following snap shots of CEO and President of The Deseret News posted on the Internet.

These snap shots illustrate in the story my testimony that God had told me what to do, what to say, and who to say it to. The harm upon our society as labeling this as a psychotic action is what? No one can say In God We Trust anymore? No one can say, "God told me" and its a direct violation of our God Given Rights and Freedom. God gave us our Freedom. Men did not give it to us. Thus it is only evil men that seek to take away our freedoms. Many times in our Declaration of Independence as well our Constitution is God referred to.

What gives anyone the right to say God didn't tell me that and take away my Freedoms and Liberties and imprison me for it? No one has that right and its a basic right of our inalienable rights. You can certainly tell me to 'shut up', but its the penalty that was attached to it that makes it an infringement of my rights based on MY RELIGION. Did anyone else go to prison? Was anyone else charged? No. So, what we have here is two religious interpretations of my words.

Does the State have the right to come into the Church and dictate terms? That's actually a good sign there is a Tyrannical Dictator involved in Government. Where there is a difference of interpretation and evidence supporting mine exist physically, and the evidence of their's is not, whose should the State's favor? Well, the state and the newspaper should observe mine. I in fact did have nothing but a brief case full of scriptures I do think are dynamite one of which was a Book Of Mormon, most Mormons will tell is not fake, but is abbreviated B.O.M. This makes any headline using the word Bomb a false narrative, a fabrication, an embellishment or aggrandizement of facts.

So, what does that have to do with the headline of The Deseret News story? Well, you can clearly see not only has their headline been false for twenty two years, but they have embellished it contrary to the State charges which amounts to a fabrication of deceit upon the public in a religious assault to me, my family, and my friends making them fear ever hearing from God. That is a hate crime based on an assault upon our inalienable rights. Are you going to arrest Katy Perry next for saying she heard a word from God and received a confirmation for it at the Superbowl half time show or is that ok, because you agree with it?

Now the headline from the Deseret News says what? Well, its false I did not plead guilty to a "Bomb Threat". That's totally false! I mean Brian Williams mis-remembers his helicopter being shot at, and is suspended for six months from a job that pays 10 Million a year and the Deseret News wants to fabricate my life everyday for the rest of my life, make a profit selling advertisment on it, and cut out the "year", so in the general public's mind they supposedly serve, a fabricated story is up every day? That's a hate crime! The first paragraph of the story is totally false.

These are fabricated and false headlines meant to do me much more harm in a nefarious intent over a life time! Because I only have one, I have to protect it and there clearly is a much more sinister and libelous account coming from The Desert News that for some reason is much longer lasting. The connection of ownership with the LDS Church Leadership is the obvious connection, and accounts, perhaps on a broader scale the exaggeration and fabrications of falsehood in reporting with the connection of the cover-up of the video tape that has protected those of its members who participated in the mob like violences against my person.

Now I can say nearly every day over twenty two years, I have been psychologically pounded with defending myself of the false report specifically and intentionally kept in the public eye as if it happened yesterday by The Deseret News CEO and President who has a direct tie to the LDS Church 12 Apostles and Church President who have held my evidence and protected the prosecution of others in their assault upon me. That is happening today as vigorously as it was twenty two years ago. This is a hate crime against me based upon my Religion and the word of God to me.

I'm telling you I should not be persecuted or prosecuted like this. We have laws forbidding it and my suffering is intense and is pretty well recorded yet I have no relief and I'm sick of it. I can not bear the fault for relaying a message from God, and that's all I did. I was not playing the enforcer role. I was reporting the truth that was no harm or threat to anyone, yet it is still being framed that way by The Desert News owned by the LDS Church and this is a hate crime against a candidate for Office that is protected as a Federal Activity.

Now the Deseret News has heard my complaint before, but they have not heard that the complaint was formalized into a Civil Rights law suit for damages, and forwarded to the FBI for prosecution. Now if you type in "Cody Judy" you get an even worse scenario the Wiki page of Howard W. Hunter and two stories from the Deseret News, one from BYU Universe regarding this. It takes 5 pages to find another story from another newspaper that has a story actually from the Daily Clipper that revolved around my run for the U.S. Senate in 2004. This is why the policy of continual persecution from a Religious Bias or Prejudice exist with The Deseret News and I feel full fills the hate crime criteria.

COLLABORATIVE FACTS OF LAW

The Hate Crimes Bill of 1969 that are also afforded in the more recent Mathew Shepard Act are as follows:

Conspiracy Against Rights, 18 U.S.C. § 241. Section 241 of Title 18 is the civil rights conspiracy statute. Section 241 makes it unlawful for two or more persons to agree together to injure, threaten, or intimidate a person in any state, territory or district in the free exercise or enjoyment of any right or privilege secured to him/her by the Constitution or the laws of the Unites States, (or because of his/her having exercised the same). Unlike most conspiracy statutes, Section 241 does not require that one of the conspirators commit an overt act prior to the conspiracy becoming a crime. The offense is punishable by a range of imprisonment up to a life term or the death penalty, depending upon the circumstances of the crime, and the resulting injury, if any.

Voter Intimidation (upon the readers of The Desert News,State of Utah Citizens, and in fact all the People in the Nation with my Candidacy for President in 2008, 2012, and now 2016.)

Intimidation of Voters, 18 U.S.C. § 594
Section 594 makes it illegal to use intimidation, threats, or coercion, or attempt to use any of these means, to interfere with the right of another to vote or vote as the individual chooses, or to cause the individual to vote or not vote for any particular candidate for federal office.

Damage to Religious Property
Damage to Religious Property, 18 U.S.C. § 247. Section 247 of Title 18 prohibits anyone from intentionally defacing, damaging or destroying religious real property because of the religious nature of the property, so long as the crime is committed in or affects interstate commerce. The statute also prohibits anyone from intentionally obstructing or attempting to obstruct, by force or threat of force, a person in the enjoyment of that person's religious beliefs, where the crime is committed in or affects interstate commerce. Finally, the statute prohibits anyone from intentionally defacing, damaging or destroying any religious real property because of the race, color, or ethnic characteristics of any individual associated with the property, regardless of any connection to interstate or foreign commerce. Section 247 also prohibits attempts to do any of the above.

It took me years to convince my own mother I did not have an incendiary bomb or device because the authorities used theirs to blow up my Bible and B.O.M. (Book of Mormon). They did it to frame me and deceive the whole population!

The Matthew Shepard and James Byrd, Jr., Hate Crimes Prevention Act of 2009 , 18 U.S.C. § 249. Section 249 of Title 18 was enacted as Division E of the National Defense Authorization Act for Fiscal Year 2010 (starts at pg. 646 of the Act). Section 249, which went into effect in October 2009, created a new federal criminal prohibition against willfully causing bodily injury (or attempting to do so using fire, a firearm, or another dangerous weapon), when (1) the crime was committed because of the actual or perceived race, color, religion, national origin of any person, or (2) the crime was committed because of the actual or perceived religion, national origin, gender, sexual orientation, gender identity, or disability of any person and the crime affected interstate or foreign commerce or occurred within federal special maritime and territorial jurisdiction. The law also provides federal funding and technical assistance to state, local, and tribal jurisdictions to help them to more effectively investigate and prosecute hate crimes.

Summation
The damages to my life are extensive and as a practicing Christian I believe these are punishable by law. The Cover-Up is scandalous. The Frame Job nefarious. The Prosecution and persecution sinister, intolerable, and happening every day.
I feel conservatively the penalty for the LDS Church Leadership ought to be at least $100,000 per year for 22 years that's $2,200,000.00

For The Deseret News Corporation who has profited upon the fabrications a conservative judgement might be $100 for every day that has passed for 22 years those stories have run- that's $803,000.00.

These would be no more than slaps on the wrist to them and I know that. I'm not trying to run anyone out of business here or destroy something that has been built. I'm fighting for our rights and respect for people and everyone's individual rights. I don't want anyone to have to go to prison like I did. That idea is not appealing to me because I value freedom and liberty so much, but I need a honest penalty to be paid now not only for me, for the honor and respect of our community, my friends, and family as well myself.

BEFORE THE STATE RECORDS COMMITTEE OF THE STATE OF UTAH UNITED TELEVISION, INC., a Delaware Corporation, d.b.a. KTVX CHANNEL 4, Appellant, v.
UTAH BOARD OF PARDONS AND PAROLE, Appellee DECISION AND ORDER, Case No. 94-13 By this appeal, United Television, Inc. seeks an order compelling the Utah Board of Pardons to release to it a copy of a video tape regarding an incident at Brigham Young University regarding an assault on Howard W. Hunter, an official of the Church of Jesus Christ of Latter-day Saints. The initial hearing on this matter was held on July 27, 1994 in which the parties appeared and presented argument before the Records Committee. Based on the issues that were raised in that hearing, the Records Committee requested the parties to research and submit memorandum to the Records Committee on the topics discussed. The Records Committee continued the hearing until the memorandum were submitted. The parties did submit the requested memorandum and the hearing was reconvened on October 5, 1994. The State Records Committee, having reviewed the materials submitted by the parties, having heard testimony from witnesses, having heard oral argument and having solicited public comment at the time of the hearing, and being fully advised in the premises, now issues the following Decision and Order. BACKGROUND 1. The video tape sought by United Television, Inc., was supplied to the Utah Board of Pardons by the Utah County Attorney's Office in response to a request of the Board of Pardons to supply information on Cody Judy, an inmate at the Utah State Prison who had pled guilty and was incarcerated for an assault on Howard W. Hunter at a Church Educational System young adult fireside for the Church of Jesus Christ of Latter-day Saints. 2. The portion of the video sought by United Television, Inc. had been blacked out of the live broadcast and had never been published by the Church Educational System. The Church Educational system claimed copyright privilege of the material and had chosen not to broadcast or publish the portion of the fireside blacked out, but contained on a master tape made of the proceedings. 3. The Utah County Attorney's office obtained a copy of portions of the master tape showing the assault for purposes of prosecution. Without permission from the LDS church or other copyright owner of the video tape, it gave a copy of the video tape to the Board of Pardons. The Video was not shown publicly at the Board of Pardons. 4. United Television, Inc., sought release of the video from the Board of Pardons. The Board denied the release of the video on the basis that it was not a record under Utah Code Ann. 63--2- 103(18)(b)(iii). STATEMENT OF REASONS FOR DECISION 1. The Government Records Access and Management Act (GRAMA) specifies that "all records are public unless otherwise expressly provided by statute." Utah Code Ann. 63-2-201(2). 2. Materials kept or maintained by a governmental entity or employee that is not a record under GRAMA is not subject to release and disclosure under the Act and the Records Committee has no jurisdiction over such records. Utah Code Ann. 63-2-103(18)(b). 3. Copyrighted material maintained by the State or any of its agencies is not automatically excluded as being a record under GRAMA. The provision excluding copyrighted material includes provisions that it is not a record if access to the material held by the public entity is limited by copyright. 4. The Church Educational System of the Church of Jesus Christ of Latter-day Saints intended the material contained on the videotape to be copyrighted from its inception and gave no permission for the material contained in the blacked out portion of the video tape but contained on the master to be released to the Board of Pardons. The Church Educational System also never published the material which is subject to the request of United Television, Inc. 5. If the video does not fall under the exclusion of Utah Code Ann. 63-2-103 (18)(b)(iii), it is a record and subject to the jurisdiction of the Records Committee to order released if the Records Committee finds it is not protected by other factors. 6. Testimony and evidence raised the issue of the video being subject to a secrecy order entered by a Judge of the Fourth District Judicial Court in Utah County. The Records Committee need not reach this issue because it resolves the issue on other grounds. 7. The video segment sought is not a record under Utah Code Ann. 63-2-103(18)(b)(iii) because the owner of the video intended the video to be copyrighted and never published it. ORDER THEREFORE, IT IS HEREBY ORDERED THAT the decision of the Board of Pardons denying release of the video tape sought by the Appellant is affirmed and the appeal is denied. RIGHT TO APPEAL Either party may appeal this Decision and Order to the district court. The petition for review must be filed no later than 30 days after the date of this order.
