For eight years Democrats and Establishment Republicans refused to see Obama as an Constitutional Ineligible person in the Office of the President. An illegal in the highest office was a slam to the U.S. Constitution and the requirements of [natural born Citizen] ie. born in the U.S. to Citizen of which not a single law suit will come upon President Donald Trump because, and get this quote out of U.S. Supreme Court Case Minor v. Happersett, "There is no doubt" about those born in the Country to it's Citizens.

President Trump just issued a 3 month ban on the citizens of seven war torn countries from entering the U.S. and the Democrats go nuts without any recollection of the pain that we have suffered and endured for eight years? Now what? The ship changes course and the boat gets rocked and "What United States Constitutional Protection" should they turn towards in their next eight years of pain?

What value have they given the U.S. Constitution who they seek desperately to save them now from President Trump's Executive Powers? How they encouraged Obama to rule by fiat and now that fiat turned upon them?

And now nothing short of an impeachment or a reckoning that Obama was in fact unconstitutional and the voters by that fraud have been defrauded out of the political circumstances our Elections have been held under for the last three elections, that are now cause for a New Election, can legally be turned to.

Section 1, Clause 5 the requirement intended to protect the nation from foreign influence, she had to be sedated after losing the last one, one wonders why she cannot see that simply taking a stand for what's right would be the best way to challenge Trump's own Election, even in the Post Election fray of 2016.

The natural-born-citizen clause has been mentioned in passing in several decisions of the United States Supreme Court, and by some lower courts that have addressed eligibility challenges, but the Supreme Court has never directly addressed the question of a specific presidential or vice-presidential candidate's eligibility as a natural-born citizen. Many eligibility lawsuits from the 2008, 2012, and 2016 election cycles were dismissed in lower courts due to the challengers' difficulty in showing that they had standing to raise legal objections.
Judy v. Obama 14-9396 was the most radically dismissed of these because Cody Robert Judy was indeed a Presidential Candidate with Standing and experts have suggested that the precise meaning of the natural-born-citizen clause may be decided by the courts as a justiciable political question as the Pennsylvania State Supreme Court ruled upholding. The best argument listed on page 12 of the following Certioari  involving Sen. Ted Cruz in a ballot Challenge stated in Elliott v. Cruz:

Judge Pellegrini correctly held that it is not an impermissible political question for a court to analyze and determine what an Article II natural born citizen is. But he also held: “Having extensively reviewed all articles cited in this opinion, as well as many others, this Court holds, consistent with the common law precedent and statutory history, that a ‘natural born citizen’ includes any person who is a United States citizen from birth.” 

This of course directly contradicts 'construction prohibitions' upon the Constitution.  Article II, Section 1, Clause 5's {natural born Citizen} requirement would than be inconsequential, in contrast or conflict and made moot with the passage of the 14th Amendment. There are multiple SCOTUS rulings that state and hold as precedent that when two or more principles of the Constitution come into conflict both both must be given their just due and neither can be overruling without Amendment.

This affirmation would hold a difference between the qualifications of {Citizen} in requirements for Representative and Senator and President at the time of the Adoption of the Constitution, to the now required {natural born Citizen}.

That difference would be seen as no foreign allegiance by Birth or Parents in the definition stated as the U.S. Supreme Court held in Minor v. Happersett -Born in the U.S. to Citizen Parents was never doubted!

Still, Democrats even at the loss of a 1.2 Billion Dollar Campaign in 2016 with Hillary, will fight on to defend a Defacto President whose terms are up by Constitutional Standards limiting a Person to two terms. Why? 

If Democrats in fact respected the U.S. Constitution, let's say if Hillary Clinton respected the U.S. Constitution, she would understand and uphold the two term limits just as directly as upholding the natural born Citizen clause as a total American Allegiance in {natural born Citizen} against Obama holding the Office of President for three terms or at all, because he is not qualified.

Why hold up two terms if your not going to hold up {natural born Citizen}? The conundrum is the most glaring hypocritical stand in the history of the United States, especially now as it relates to Trump securing the Office of President and nominating U.S. Supreme Court Justices! They are , Hillary is a RepubliDemocrat- she was Republican first Democrats, and remember Republicans have far more Candidates in the wings who are not natural born Citizens including Rubio, Cruz, Jindal all mentioned in Judy v. Obama 14-9396 that the U.S. Supreme Court dismissed based on failing to pay the money because of poverty in affect denying Justice because of Price for Sale.

If Hillary or Democrats cared in the slightest about the nation, if they psychologically didn't in fact support Donald J. Trump in the White House, don't you think they would come out and take a stand against Barack Obama with this legal foothold to stop Donald Trump? That just proves to Democrats everywhere that Hillary Clinton was a joke and actually supported Donald Trump though she led on she was an opposing Candidate for Democrats. 

If the U.S. Supreme Court in fact challenged Obama's ineligibility with a Justice Ruling of Judy v. Obama 14-9396, found unjustly canned within the next 40 days, and had a ruling finding Obama is not eligible, how with those circumstances changed, could the Election of 2016 possibly be seen as anything other than Constitutionally Fraudulent to the conditions the United States of America actually was in and the American People actually able to Vote with those conditions understood? 

It's as fraudulent as lying to the Public in order to get elected. The whole system is rigged and we'd need to either schedule another election or Congress would have to do something. Maybe we hold another election and Hillary wins when Obama is found to be a Fraud? Maybe we have an Election next year and Trump is put on hold for now until it's sorted out? The Senate has the ability to appoint a President pro tempore. 

This is why frankly, Donald J. Trump should reconsider Hillary Rodham Clinton for Secretary of State, she totally supports him and Republicans, just as they have supported Obama. Trump never filed a single paper or ballot challenge against Cruz, Rubio, or Jindal with the standing he recognized he had.  

If Obama's found ineligible by the U.S. Supreme Court, and Donald J. Trump is found to be a fraudulent Birther even as Obama is found to be a fraudulent defacto president, does he still have the Vote of the People that Hillary called his 'base'? What is most certain is a whole bunch more questions need to be asked.

But, we must be careful not to view Trump’s actions through the prism of the old political playbook or we will continue to misjudge and underestimate him just as we have for the past 17 months.

What is very noteworthy for Media Pundits is that considering the amount of Birther Bashing that they and Hillary Clinton did with Trump and that not affecting the Constitution's defined Electoral College means they have been barking up the wrong tree if their intent was to stop Donald J. Trump at all. If their intent was not to stop Donald J. Trump then of course they have been supporting Trump all along and rigging the election away from Hillary. Truth to consider.

Of course Obama has gotten away with a lot but this Nation is not for sale nor will it be blackmailed by fraud or treacherous trickery. This has been my duty as a Presidential Candidate who has standing. Running in the race carries a very big responsibility and I hope America sees I've carried that well and not taken it for granted."

There has been a lot of speculation amid Sen. Ted Cruz's announcement to enter the race for President in the coming 2016 election. "I'm sure he knows he is not qualified, and a witness says Sen. Cruz acknowledged in a 2012 interview that Born in the U.S. to Citizen Parents was the requirement and Obama failed. Obama knew too, but what these men also know is how dog-gone hard it is to catch a thief. The problem has been being able to prosecute and hold the line even as the qualification for President as a natural born Citizen were being usurped by bullies. The Court processes take a long time. I've been involved with them since 2008 and sued McCain and Obama.

Judy points to long uphill court battle the LGBT community fought and how long it has taken them for their individual rights to be recognized in sanctioned unions of marriage by the Government and a fair tax credit. "I'm no different in wanting my Individual Rights recognized to run a fair race with all requirements of qualifications expected from every Candidate for the Office of the President", Judy said.

During Obama's visit to Utah he met with some of the Mormon Leaders there. LDS Church spokesman Eric Hawkins said LDS President Thomas S. Monson, age 87, skipped a meeting with Obama to preserve his strength for the LDS Church's General Conference this weekend. Shortly after President Barack Obama landed at Hill Air Force Base, he rode by motorcade to Salt Lake City where he had a private meeting at the Sheraton Hotel with Presidents Henry B. Eyring and Dieter F. Uchtdorf of the First Presidency and apostles L. Tom Perry and D. Todd Christofferson and it was noticed that Obama thanked them for their support in the new LGBT Law prohibiting discrimination, acknowledging the individual rights, and religious freedom.The measure took seven years to pass.

That's about how long it seems I've been working through the loops of the Court in the emphasis of the Office of the President's unique qualification as a natural born Citizen and its a tough battle not only fought in the Court but fought in campaign of the public arena. Especially when the Media paints such a tough "racist" head strong wind to go against even though Sen. McCain was the first on my list to check check in U.S. Federal Court. That's happened a lot with Obama with others like Donald Trump, and Obama himself has insinuated the racist card many times in efforts to bring this issue of qualifications to the Court of Justice calling those Birthers circus acts and carnival barkers the day he handed out his fabricated long form birth certificate.

It took us back. We had to do some checking all the while Obama is redirecting the press as a big war hero getting Osama bin Laden the next day. There we are scrambling to check out a document almost immediately reported a forged document but it took law enforcement over 2500 hours and many many test were performed to come up with the official analysis signed in affidavit by the law enforcement investigation included to the Supreme Court of the United States in this Writ.

That hasn't been the only challenge to work through. We've had scholastic academic professors who have ventured over the line trying to merge the term "Citizen" and "natural born Citizen" in spite of the Constitution's clear distinction that Citizen was the requirement "at the time of the Adoption of this Constitution" U.S.C. Art. II, Sect. 1, Clause 5. These are respected and intelligent people from prestigious universities offering their commentaries. Still, Congress since 2003 has attempted to change the 'natural born Citizen' qualification to "Citzen" in the qualifications for Office for President. Its failed every time, which in summary is the witness and voice of the People not wanting it changed. There is a process to Amend the U.S. Constitution and it is not by listening to a few commentaries who wish to see it changed. Our elected leaders have more authority over the term then they do by the voice of many.

The fingers have been pointed that the Constitution didn't explain or didn't come with a dictionary of terms but with using deductive reasoning we can suppose that every type of "Citizenship" discussed in 3 U.S. Code: Title 8 Aliens and Nationality §1401 a-h really describes for us every event of Citizen. The only one missing is "Born in the U.S. to Citizen Parents which is natural born Citizen. The Constitution didn't define pirate either, but we know what one is.

THE CRUZ AFFECT BRINGING BI-PARTISANSHIP INTO THE COURT RULING

While Birthers have been getting slammed by Republicans and Conservatives for Sen. Ted Cruz it might prove the best thing to happen because suddenly a decision from the Court is bi-partisan. Title 8 (g) describes his circumstances as naturalized or codified by Government. [Nationals and citizens of United States at birth (g) a person born outside the geographical limits of the United States and its outlying possessions of parents one of who is an alien and the other a citizen of the United States.] A person fitting this outline is Sen. Ted Cruz born in Canada to maybe one U.S. Citizen. His mother may have a Canadian citizenship if she naturalized like her husband. If that's the Case, Texas did not elect someone who was even a U.S. Citizen qualified but a Canadian natural born Citizen.

There really are only two kinds naturalized and natural. A natural born Citizen actually is the only circumstances prohibited in or from Title 8. and the reason is it is never doubted that one born in the Country to Citizens are natural born Citizens, and that is the requirement for the Office of the President. So asking what is a natural born Citizen hasn't been the right question. Its the deductive reasoning that is very available in Court that asks, "What isn't a natural born Citizen? We find that out in Title 8 describing all the types and variations or qualifications of "Citizen".

The good thing about this is it subsides the Court's own hesitation based on what's termed the doctrine political question.

REQUIREMENT OF COURT TO CALL WITNESSES and INVESTIGATIONS BY CONGRESS.

This Writ is diverse as it is capturing calling witnesses of profound importance to testimony. Like former President Bill Clinton and Hillary Clinton to witness under oath at things they have been reported to say and to have said as to evidences they posses that Obama was not qualified and the complications and perils they faced in retaliations for their witness of which I will not elaborate upon at this time, but are key in the chilling effects doctrine of standing and important witnesses.

It is a precious document and we are not at liberty to wipe out, dilute, or merge terms that have been a great defense for us all except the very rights you as an individual cherish will be wiped off the face of the Earth and you will have nothing to turn to because you turned your back and diluted the Office of the President and thought so little about the sacrifices made for you by those who gave their lives that our Nation might be Born.

Breaking News Update: Judge Recuses himself in new Judy v. Obama et.al., 2014 Case

An interesting development has come to my attention on the new U.S. District Court case filed here in Utah in Judy v. Obama et.al., Case No. 1:14-cv-00093 that I wish to address to quell rumors of all sorts being directed in the case.
This is a new case that has been filed and is separate, unique and an original filing compared to the ballot challenge litigated to the U.S. Supreme Court in Judy v. Obama 12-5276 that began in Georgia’s Administrative Court with Judge Malihi.

Yesterday, July 24th, 2014 I received notice that the originally assigned senior Judge Bruce S. Jenkins recused himself by an order he originated. This Order was not pre-empted with a Motion for Recusal by me or the Defendant(s) in the case.

To my knowledge this has never happened before in any case to date which in some way involved Obama’s qualifications, or injury due to the ineligibility, qualification, or occupation of the Office of the President involving Obama in a plea for the Court’s due process for injury in a Civil Rights and Federal Act violation Complaint associated with the allegations asserted by myself as a Presidential Candidate in the presidential election race(s) 2008, 2012, 2016.

I want to make clear that this case does not ask the Judge to remove Obama from the Office of the President whatsoever. That in my mind, and many in the Judicial Branch, belongs to Congress. This is simply a plea of injury and a request for compensatory damages as well as statute damages due to violations alleged in the presidential contest or race according to the rules of the race.

As for the action of Judge Bruce S. Jenkins to respectfully recuse himself, I do not have any definite answer. Judges may recuse themselves for a host of reasons, and in many instances have a responsibility to dismiss themselves for many reasons which can range from a conflict of interest due to work done outside their judgeship, to personal life events which they feel might serve as a conflict interest to the adjudication of the case, to a complication of their own circumstances in health, time, and ability to serve in the particular case interest.

I do know Honorable Jenkins is a senior court judge and he has served the Court for many years. Senior Judge Status is given to Judges who have reached a certain age and have served a certain number of years and they serve the court in a limited capacity as the court may need them rather than say a full time judgeship.

The Order of recusal being signed by Judge Jenkins also enumerated the case being reassigned to the Chief Judge of the Utah District – Judge Ted Stewart for all further proceedings.

It is probably best not to read too much into this development although it does serve as interesting “wonder why?” speculation. Of course that is all we can do is speculate as to the reasons why because we do not know of any certainty. Has it ever happened in a ‘Birther case’ as the media is fond of labeling them? No, I do not think it has.

PIONEER DAY CELEBRATED IN UTAH

On to a different subject, July 24th, yesterday, was a great celebration in Utah known as “Pioneer Day”. Pioneer Day was celebrated originally as far back as 1849 and celebrated the day when Brigham Young entered the Salt Lake Valley area from a long and treacherous continental trek and said “This is the Place” of settlement.

Looking for a place to practice religion freely without treachery for their religious beliefs the Mormon Pioneers braved an incredible exodus out of East Coast States. Later, in 1897 the 24th of July also incorporated Utah’s entry as a State into the United States of America and has continued on to this day.

As a Utah resident I certainly enjoyed the festivities and celebrate the pioneer spirit of innovation, productivity, self reliance, patience, courage, and determination though I do not represent the LDS or Mormon Faith as a member, nor did the effort and trek made by many pioneers of many different religious sects and faiths owing the same gratitude of excellence as great examples of pioneer spirit.

I will say one of the things I do love about parades is the seeing the police forces of the community in them celebrated as a service for the members of the community. The following video made includes a few highlights from the 24th of July Parade and spectacular fireworks seen on the 4th of July in celebration of our Nation's Independence.

Breaking News: Judy v. Obama-Motion to Proceed Granted Summons Served and Returned

Breaking News: Judy v. Obama Judge grants Motion to Proceed. Twenty day Summons issued by the Court, served, and a Return of Service filed.

This is a big part of the go ahead to step forward in the proceeding. Judges have seen the filing before it was served and recognize the complaint with a case number and the first Motion to Proceed was granted.

The Twenty Day Summons was served on the Defendants, or substitutes admitting they are capable of receiving service for defendants.

A Return of Service is then witnessed and filed in the Court marking the time table to respond and the beginning of the twenty day time period given the Defendants to respond to the complaint.

It was a very difficult day to say the least as so many people are fearful of retaliation for serving the complaint. I asked for help from many who said politely, "No thank you".

In the end I was so humbled and confirmed with the courage that my own Mother demonstrated at 78 years old who gave me a call of her own free will and said without my asking, she'd be happy to do it.

To understand that courage, you'd have to know she's had three back operations and been through cancer and chemo treatments twice over the last four years and at 78 has some great disability at moving and traveling like she used to.

I was floored as I had not asked her before she called me. I hope some day the courage of this woman might be recognised as the foundations upon which mine was built.

My cars air conditioning is broke and its about 75 miles round trip, plus I had my 5 yr old son with me. I could not serve the complaint but I could help her out of the car, down the stairs and into elevators.

The day seemed like it was in full blown slow motion to me. I felt honored to be between these two individual who seem like my favorite angels on earth.

One crying for his cup of juice, the other how much it would cost to get my air conditioning fixed and why fighting an infection she wanted to do this.

She said, "Cody, I've watched you for seven years apply your time and talent to an issue for our Constitution. You're contributions have been great, but the contributions from the public small. I know your heart is good and you wouldn't call what your doing a waste of time. Who am I to say it's a waste of time? If its important to you it's important to me."

I thought I want to remember those words forever because they meant so much to me. In the end, of course the legal system is frought with peril, and it is not always easy to navigate it's treacherous twist and turns, but let it not be said that I was not grateful for the love and courage those around me exhibited.

As I have felt I could not let those who supported me as a Presidential Candidate down in doing my best to defend, protect, and preserve the Constitution, I hope they will also notice the hardships and courage of those around me.

Success is not always about winning, but we have learned it is also about doing your best at whatever it is your doing,let the consequences follow.

I was grateful and honored to have my Mom introduce my nomination for other political races I've run as some may recall and which is also written in my book, "Taking A Stand". Some said a little of this or that about it, preferring or advising a more popular political figure, but as for me, I don't know anyone more responsible for instilling in me a defense for what is right.

That's ok with me. There are many individuals standing up for what is right in history who were not all that popular with the law. Contributions of what is right made by less then perfect people are none the less valuable.

In light of this we call on all Media Sources to quit hiding from the American Public the enormously important case of Obama's ineligibility for the Office of President coming up for conference in the United States Supreme Court Sept 24th,2012 in Judy v. We share an added emphasis on exactly what makes America different from the rest of the world. Gov. Mitt Romney strongly endorsed American values and our Constitution in his platitude. We would challenge Gov. Romney's statement as nothing more then lip service or a clandestine form of watered down politicking simply because he hasn't taking a stand against the greatest threat to our national security in Obama's ineligibility and the facts that through the office of the Presidency our enemies can gain more leverage against America then any terror action across the globe.


Not only have our enemies been embolden by the apologetic tone of the Obama usurpation administration, but we Americans are all mocked and chided at having a Usurper in the White House by our allies as well by our enemies and are seen as nothing more than hypocritical at our best and worst. With Mitt Romney covering up for Obama's ineligibility, Obama gains the platitudes of anti-american disdain of which our enemies soak and distribute as gasoline to be ignited against our Constitution and Country.

You know many more people are tuning into the Presidential Race after the conventions now and I have a very special date coming up. That date, TWO WEEKS from now, is Sept. 24th,2012 in The United States Supreme Court, case Judy v. Obama 12-5276, and I need your help because there’s an IRON CURTAIN in the Media that I need your help with in TEARING DOWN! Remember Ronald Reagan saying that? Well guess what its’ here in America now.

As a facebook friend of mine 100 to 1 your conservative and will probably vote for Mitt Romney in the general election, however, I want to ask you if you’d like to double your odds at getting Barack Obama out of the White House before that; for $25.

One normal $50 dollar commercial for any company only cost a Presidential Candidate about $25 dollars and is estimated VERY conservatively to reach over one thousand people. I have about 4,500 facebook friends. If each gives $25 dollars we can reach conservatively four and a half million people and tune them into what’s happening in the United States Supreme Court in two weeks; but that’s not all.
With 4,500 commercials we gain major credibility ground with the networks that must air our commercials or can face big law suits for denying the Federal Guideline Standards of Advertisement for Presidential Candidates. That’s a law suit any attorney would delight to get their hands on because of the huge fine. We also gain credibility in the face of the Court which has never been done at this level!
Now $25 dollars is just between you and me, your name does not have to be reported to the FEC unless your contributions exceeds $200, so Mitt Romney is never going to know and you could still vote for him in Nov if you choose. Be my guest if you can contribute more than $200! (smile)

As you know Mitt’s taking on Obama on just the economy, but I’ll bet within the next two months you see gas prices going down, as well as employment numbers reported to the media and by the media by you- know-who. I’ll bet $25 that you might see it reported as 7.9% the first of November and guess what? Mitt Romney loses the economy battle as hope has suddenly and miraculously sprung back into the economy, we have to face it, that’s the way a major portion of our fellow Americans think.

That’s exactly what happened in reverse to John McCain in 2008 to help Obama out; thanks in large part to Saudi Arabia’s kings Obama bowed himself so low to. Don’t you think there was not a reason Obama bowed so low. Of course a U.S. President should never be beholden to a foreign power.

So, we Birthers have one more shot at this in the U.S. Supreme Court that is liberal of course, but guess what? I’m running as a Democrat in the same party objecting to campaign damage because Obama won the nomination and isn’t ‘playing by the same rules’ as Mrs. Obama quoted they think America should, and ‘it’s just not fair’. It’s a no brainer and my case has Sheriff Joe’s Cold Case Posse investigation set in it and has from the onset from the lower Superior Court in Georgia. This has never happened in BIRTHER HISTORY exactly!
How about holding the Obama’s to the same standard they profess? Wouldn’t that be a treat for $25?

Doubling your odds to get Obama out, preserving your vote for Mitt Romney, and being able to tell God in your prayers tonight you have done all you could do. That’s pretty good deal, and I believe you could hold yourself blameless before God if you could do that.
You see I am a Christian and I don’t mind telling you in my opinion God will do most of the work. He only wants us to just show a little faith in him. Think of coming an inch while God has come a whole mile.

Well most of the work is done. Our case is in the U.S. Supreme Court now; the Campaign has been built from scratch, we just need a little publicity. That’s the inch I think God just wants to see from you, and I believe we can be successful together. I just can’t do it alone.
Here’s a little rhyme for you to think about: “It may come down to one single Justice and I believe God can handle one heart if you will just show him your little $25 part. WE can build this truck together!

Well I believe our Constitution was inspired by our Creator, and I know our Founders and Framers did to. You might not agree with their religious principles or mine, but we both neither can deny the freedom and liberty our Constitution has given to us our whole lifes.

George Washington is my favorite U.S. President, can’t say as I’ve met him, but I’ve sure felt his spirit as a hand on my shoulder throughout the 12 courts over the last 4 years I’ve been through to get to this moment in the United States Supreme Court against Obama’s eligibility. Can you pitch in a little?

A commercial is intelligence and knowledge for the general public and in 1796 Pres. Washington said, “it is essential that public opinion should be enlightened”, “A primary object for our youth should be education of our youth in the science of government. In a Republic, what species of knowledge can be equally important?”, and he said it was our duty, communicating it to those who are to be the future guardians of the liberties of our country.

If you see any other Presidential candidates around with Obama in the U.S. Supreme Court before the General Election I recommend you contribute $25, otherwise my friend, I hope you’ll log on now and get that $25 to me in my goal to reach 4,500 commercials in two weeks.
